my application for immigrant visa was send back to the homeland security/NVC

I will start by saying I give thanks to God for all he has done for me αи∂ the gift of life. My interview was the 21st of dec I went for it but was not granted the visa instead it was send back to the homeland security/NVC that it looks like fruad or let me say her used the word scam cos my wife send money to me sometimes for up keep cos I was going to school αи∂ I don't work pls what is the next thing for us the CO said my wife can appeal but the thing is this what is the chances I will get the visa if she appeals αи∂ how soon or what is the best advise someone on here can give. I will be glad to read from someone soon. Thanks αи∂ Goood bless you all.

Sorry to hear that, it really depends up to case to case.

What was the reason? Did you get 221g slip? Did it give instructions about what you need to provide? You have to explain little more to get aware about your case.

The thing is this my wife is 20yrs older than me αи∂ the C.O was so rude αи∂ was laughing me. Αи∂ he was like it looks like a scam that my wife send me money. Αи∂ that I possibly have a lot of women I talk to αи∂ that my application will be send back so my wife can appeal it. Pls I will be so glad if you can help am highly depressed now. My wife is helping any ways cos she very supportive.

It takes a lot to convince the COs especially when there is such a huge gap in age between the couple and then the female is the older. From a very close friend's experience and some posts from VJ its appears NOIR ( notice of intent to revoke, if that is waht you got ) takes MONTHS to move from the embassy back to USCIS. There is a lady VJ member (Tina& Isreal) who posted something similar( age and money were not the use though) read it and maybe it will help you. Infact someone who must have been following VJ told my friend about that story and my friend who is not computer literate asked me to search for and visit the website , read the story and tell her if it can be applied to her situation and that is how I came to VJ and stayed!!!!

09/26/2012: Mailed I-130 from Nigeria( delayed by customs)
USCIS stage ( 66 days)
10/12/2012: NOA 1
12/17/2012: NOA 2 (case was transferred to NYC office 11/27/12)
NVC stage ( 20 days)
01/08/2013: Case # and IIN assigned ( file arrived NVC mail room 12/20/12)
01/09/2013: AOS invoiced and paid, DS-3032 emailed and mailed.
01/16/2013: IV invoiced &paid. AOS & IV mailed in one package(arrived 01/18).

01/28/2013: Case complete!!!
04/19/2013: Interview; APPROVED!!!!!
05/13/2013: POE; JFK

Ok so I found the review ...its review # 8708 under the Nigerian embassy review incase you cant open this link below. Why I posted this the fact that while they were told their file was being sent back for NOIR, months later when the Ops fiancee arrived Nigeria, their file was still at the consulate hence their opportunity to have second interview so...

I understand that! Most important thing is that if you are able to schedule 2nd interview, but you still would need some strong proof that you guys have a bonafide marriage. Did you bring all necessary supportive documents? Like how often you both met? How much you guys have spent the time together? etc etc.

The next thing that you can do, follow the instruction as 221g slip says. And wait for some user feedback who have gone thru this 221g process, so they can share better experience with you.

The age difference (20 years) will continue to be a huge factor if she has passed the age of child-bearing. This doesn't apply to everyone; it however applies to Ghanaian marriage in relation to culture since children are considered the pride of marriage. The CO understands how families in Ghana attach so much significance to child-bearing and how a Ghanaian man would be hesitant (if at all will) to marry a Ghanaian woman who has passed child-bearing age. With this, you're going to have to proof beyond any reasonable doubt that, you're among the few people who would forgo the consideration of age difference and marry someone (Ghanaian or non-Ghanaian) who is 20 years older than them. It's not going to be easy but it's possible. Gather every document necessary and have your parents and friends write letters in support.

First, if this was an immigrant visa denial, it was a CR1 or IR1 visa, not K3 that you applied for. There is nothing for the foreigner to do at this point. In a few months, the US Citizen will have an opportunity to appeal what is called a "Notice of Intent to Revoke" the approval of the I-130 petition. If successful, the case will be sent back to Accra for a second interview.

In my experience, unless the US Citizen spouse arranges to go spend at least a couple months living together with the foreign spouse as husband and wife before the next interview, there's little reason to expect a different outcome from the second interview.

Facts are cheap...knowing how to use them is precious...

What is even more interesting is that if he was marrying a man the age difference would more than likely not even be a problem. What a mixed up world we live in. I am 10 years older than my husband who already has kids, that is why I will be sitting at the interview. I am fortunate and by Gods grace I look as young as my husband however, I want them to see me since they are so concerned about appearance.
