This is correct. The immigration officer has the authority to make corrections on the forms. They made a few corrections on my wife's forms. As long as the information being corrected isn't MATERIAL then it won't result in the application being denied, nor will it result in a finding of misrepresentation against you. A fact is material if approval depends on the fact being true and correct. Whether or not you have children is not a material fact. It doesn't affect your eligibility to adjust status.

Tell the immigration officer at your interview that your attorney made a mistake on your I-485, and you'd like the IO to correct it. It shouldn't be a problem.

I would still print out a new copy of the form with the correct information and SIGN and DATE it as of today and take that to the interview. The IO will most likely keep the new form and make corrections on the original form. THis way you are proving that you found the error and are trying to correct it to the best of your abilities.

Good luck,

Dave

Tell your lawyer you would like the corrected form printed out, regardless. If YOU want to take a corrected form to the interview, you are perfectly at liberty to do so. Then it becomes the choice of USCIS whether they amend the form they already have or accept your amended form into their records. If you don't take it, and they won't amend the existing form, you're stuck without options.

You are paying the lawyer, she should be dancing to your tune. Not the other way round. :)

Thanks! This is helpful. Now I can exhale. And stop stressing about it. :) I will sure tell the IO on our interview about this. Wish me luck! :)
