i'm on AP since november 28 2011 me and my USC fiancee had K-1 interview at islamabad Pakistan CO said we need to get another co-sponsor cos income isn't sufficient and my fiancee is jobless since about 3-4 years so i got a call from embassy today to submit IRS Tax certificate 2009 2010 2011 from Petitioner he said he was local pakistaniguy how can two ppl has to submit IRS tax petitioner and joint sponsor both very confusing and i feel so embarrassed and also they need 2011 IRS too that has to applied in April 2012 and i have to wait that long omg i miss my love so much i don't know even DOS said they want IRS from petitioner of 2009 2010 and 2011 CO knows she isn't working why the heck she has to submit doesn't make sense she isn't working and meanwhile we have to submit joint sponsor too please help and im so helpless here thanks in advance

The law states that all the income papers must be in the hands of the employees etc by the end of January. We are so close to that now. It's not that long. Have her work on the papers and get the joint sponsor info and by the time you get it altogether she can file electronically and have that back right away for sending the papers.

I know how you feel.. my husband and I have been in AP for over 6 months now still pending. You may very well get the visa after they get this info and review it. don't worry each day that passes is a day closer...

Thanks emmy(ameena) for your respond I can understand about the 2011 tax paper but y my fiancee has to submit her tax papers she isn't working the guy said he was a pakistani last night I called dos they said me the same thing that they need 2009 2010 2011 tax papers and bank statement of my fiancee but I need to show the tax papers for joint sponsor not for my fiancee she isn't working she is the petitioner I asked the guy he was not knowledgeable he said in america. Even if someone isn't working has IRS tax it was shattering for me hear that how petitioner and joint sponsor both have to submit tax papers simultaneously I'm much distracted I will email the embassy and how did your senator contact the embassy through the same embassy email how and I know u well emmy my fiancee told me she talked to u through text and I'm not very far from adeel I reside nearby him thanks

Even if she can't financially sponsor you she still has to submit those papers. She is still considered the MAIN sponsor and then the co sponsor is the one that is that is showing financial ability... maybe that clarifies a bit? so yes every person calling their loved one even if they have no income has to submit tax papers etc...

Emmy how can someone submit IRS when he or she hasn't been working for 3-4 years I don't live in usa but I do have a little bit info that's what poonam said she isn't working someone who doesn't work he or she doesn't have irs that's y we need another co-sponsor to show that DOS girl also was wondering why the consular asked my fiancee to submit IRS tax return since I'm getting another co-sponsor

Even if she isn't working she still has to file taxes each year.. everybody here does... unless they are exempt and that requires being qualified to be exempt and the IRS approving that.

Hello Eabbas, wht a day i had i called my accountant, he told me he dont see a way that i can file taxes since i dont currantly have an income

then i told him that i will contact IRS to be on the safe side, I was on the phone with them for over one hour and then i was advised that I

can file 1040EZ form and they will process it, so now that I have that all cleared up I hope that the embassy will accept that because its

just two pages form and there is no W2 to go with it, however thanx so much for all ur help, I will keep u posted abt the progress.

When my mother submitted her I-864 for her brothers she received a RFE requesting the same thing.

What I did is write a letter on her behalf stating this (sometimes they just need it down in writing). Her petitions were approved shortly after.

Hope this helps.....here is the sample of the letter:

My husband, <FULL NAME>, who is also my cosponsor on this case, did file tax returns for the past three years, in which I am listed as his dependent. His most recently filed (2008, 2009 & 2011) tax documents are attached to this case, along with the signed form I-864 & I-864A forms. DEAR S&S thank you so much for that info and yes it have been very helpful, however i did contact IRS today and i explain to them,and I was advised that

I can file form 1040ez, which i believe is for single no income ppls I hope that would be sufficient for them, but I have to wait until about the second

week of January to be able to get that for them. But your information was very helpful, and I thank you so much.

Moshin,

I would recommend your fiancee in USA get a family member to co-sponsor immediately. Because the US Immigration is wanting to make she can financially sponsor you. If she hasn't been working for 4 years, that's a huge red flag and 100% resulting in AP. Embassy wants to know, how she supports herself (income, savings, mortgage,etc..). In terms of taxes,as a US Citizen, regardless of her income, she must have filed tax returns. That's the reason the embassy is requesting them. The 1040EZ form is the simple tax return for single, one-income earners in the USA. It's the very basic form for US Citizens without mortgage deductions, or businesses.

First of all u need a co-sponsor usually family member who can fillout the form show the income.

Send them 09,10 tax returns and the last few paystubs of 2011.where it shows this year's

earning. Waiting 5 months for tax returns is stupid.

P.s. No one else out of family would help u coz its like taking responsibility. Ask her to talk yo some one in the family.
