has anyone had two strikes and have to go for a third time?

My husband and I have been through two interviews, first as my fiance and then as my husband and both times visa was denied because they keep saying our relationship is for immigration purposes. I want to try for a third time but I don't know how to start again or even if I can file a third time. Does anyone have any info about this situation? has anyone been or knows somebody that has gone through tis and can tell us what to do?

A lot will depend on your specific situation:

- what country is the beneficiary from?

- Any red flags (prior marriage leading to US citizenship, recent divorce etc)?

- Any indication why they think the marriage is fraud? Ie few visits to see eachother, unable to answer questions about eachother at interview, did they do a field investigation and family didn't know about your relationship etc?

We have had a few VJers who were successful the third time, one just posted recently from Nigeria I think, but you need to address the issues which led to the denials before trying again.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

there were two couples in china, where the 3rd time actually worked.

it was rather rare, on the path, though - unsure if it will work for you.

1. k-1 interview, fail

2. k-3 interview, fail

3. I-130 in play still at NVC, so NVC intake on Immigrant Visa, CR-1. Passed at interview.

Them's the cliff notes. If you want, have the USCitizen contact NVC, inquire if the I-130 is still there at NVC. If it is, there is some chance that you can go forward with an IV. But - you have ONE SHOT at this; is best to load all yer relationship evidence from day 0 to yesterday, in with the DS-230 packet.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

With each denial you have more to overcome to convince the CO that 2 other people got it wrong. What country are you dealing with ? The more we know the more we can predict what may happen.

This will not be over quickly. You will not enjoy this.
