Travel on K-3 after applying for AOS?

Hi Everyone,

I haven't been on here for quite a while, but as this website has given me a lot more and better information than the immigration lawyer that we hired (and subsequently fired).

I've briefly looked through the posted topcis and I didn't find one exactly like this one, though if this has been asked and answered somewhere I apologize for the repetition!

Basically, my question is: Can my husband travel out of the US and re-enter on his K-3 visa after we have filed for adjustment of status? We are planning on filing for AOS, AP and EAD all at once, but I spoke to someone at USCIS today who informed me that he probably could travel on his K-3 while his other documentation was being processed. But when I asked her where that information was located on the website, she couldn't find it.

Can anyone help or advise on this? I definitely don't want him to be denied entry after waiting so long to get him here!!

Timeline

Yup, the K-3 visa is a multiple entry visa. If you look at the actual visa, I think you will even see "M" noting that fact.

Answer on USCIS website too:

"Can I Travel Outside the United States?

If you are in K-3 or K-4 status, you may travel using your unexpired K-3/K-4 nonimmigrant visa to travel outside of the United States and return, even if you are applying for adjustment of status simultaneously."

P.S...a little scary that the person you talked to couldn't find this info!!

Thanks! I was a little worried that applying for AOS would cancel out the K-3...

That is a little worrying that she couldn't find it! But I think she quoted that exact same paragraph so that's good.
