i-864 sponsor: employment letter

Hi All,

I am applying for adjustment of status by submitting I-485+I-130

My wife is an American citizen and she will be my sponsor for I-864. She is employed through a staffing agency and gets paid hourly.

The staffing company said they will mention that she is working on an ongoing project and mention hourly rate (they cant put annual salary as its not a full time position)

Will this be a problem when I submit my documents? It is necessary for the sponsor to have a full time job?

Yes - it is necessary for a "full time" position.

They look at the ability of the sponsor to support, on a continuous basis, the immigrant now and into the future.

Temp work, part time, or seasonal goes against this thinking.

What does her 1040's look like? What annual income did she claim last year?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I that case should i just submit her last year's tax returns and W2 and not submit her employment letter and pay stubs for this year?

What income documentation is required? The sponsor is required to submit an IRS transcript or photocopy of only the most recent Federal income tax return with the I-864. However, the sponsor may, submit Federal income tax returns for the three most recent years if that helps establish his or her ability to maintain the household income required in the poverty guidelines. The consular officer determines if the income claimed by the sponsor meets the poverty guidelines. If the claimed income does not meet the poverty guidelines then the consular officer may additionally request current year income information. If the sponsor is relying on income from other household members to reach the minimum required income, a copy or IRS transcript of each individual's most recent tax return is also required, and each person must complete a Form I-864A. The consular officer may request additional evidence of income, such as an employment letter.
