Hello,

We filed joint I-751 petition 3 months back. Unfortunately last week we have started teh divorce proceedings too but I don't think it will be complete before I-751 approval. But I think its better for me to let USCIS know about it & file waiver application. My spouse is having chronic mental issues & it is impossible to carry on now. I have access to his psychiatric history from insurance & also have recorded a conversation with him, where he admits of having psych issues & not able to support the relation. Will that be good enough to proove that I did everything in good faith, not knowing about his condition & now can't cope up more.

Based on your experience which peice of information or document can be a deciding factor for I-751 in positive sense & negative sense. Also, any idea how long it takes in CA for divorce & I-751 process to complete. I would really appreciate responses

I feel bad for you and I feel worse for our husband. Anyone suffering through mental illness needs a strong spouse or a strong support system. I know it must be difficult for you. Is there any classes you can take to help you deal with him and to help him in his struggles? I hope you can find a way to work it out. Has he been abusive to you or is he just sick and that is why you have to leave him?

Sept 11, 2011 NOA2-took 19 days to get case number

Sept 30, 2011 NVC number and IIN received Friday-gotta wait till Monday

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

Nov 30, 2011 Notified of Interview date

January 19, 2012 Interview- 240 days from NOA1

INTERVIEW RESULTS-APPROVED WITH 14 WEEKS AP--but he got his visa in 56 days!!!!!!

You have to show that you entered the marriage in good faith, in addition to the evidence you show above.

Co-mingling of finances, joint assets, things of this nature.

With just the items you mentioned, I do not believe that will fit the bill.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Thanks a a lot for your responses.

1. I think t takes about 6 months to complete I-751 process. But few people on forums have told me 3-4 months for California Service Center. Can someone provide me realistic figure, provided that we have filed just before the dec holidays ?

2. Do I need to be in US for any stage of the divorce process. Do I need to seperately file for divorce in my country too, where we got married ?.
