Hi Everyone,

I'm new to this forum/portal.

Our K1/I-129 application was received at the CSC 9th Nov 2011. We're hoping for a July 11th 2012 wedding as it works best for finalising my committments here in AUS, his study and our families. But we of course understand how changable that is and nothing is set in stone.

If anyone could shine some light on the following, I would be eternally grateful:

1. For those going through the K1 process or have recently gotten their interview dates booked/had their interviews, how long has it taken you to get your Visa? The overall time line indicates 7 months? Is this correct/realistic?

2. What is required for proof of financial support/stability? My fiance is a student. I am selling my property here in AUS and will have money from this. His parents are likely going to co-sponsor if necessary, though we'd like to avoid it. How much would I need to have in the bank to be classed as not needing this?

hey mate,

good idea not to set anything in stone until you have your passport in your hand.. well it took us about 6 and abit months to get the NOA2... then about 10 days or so for the national visa centre to process that... then you gotta wait for the sydney consulate to send you the P3... which can take a week.. then once you send all your p3 stuff back it can take up to a week or so to get an interview date.. interviews are usually scheduled 2-3 weeks from sending your p3 in.. and then about 5 days or so to get visa in hand once approved.. but i went through the vermont service centre which was taking alot longer then the California one that your going through.. i think you should be fine with a July wedding.. if everything runs smoothly :)

i would get his parents to co sponsor.. they will ask you at the interview how much money your going over with... well they did with me... but i do believe you will need a co sponsor... someone else might be able to tell you more about financial things....

We sent ours off in late february this year. Our NOA1 was dated March 2nd and we got our NOA2 on June...6th I think. Had my Medical on July 11th and got the results back only a few days after that. I can't remember the exact date i got my packet three etc but i had my interview on the 23rd of August and had my visa in hand on the 29th of August and arrived in the United States on the 9th of October. So form receiving NOA1 to getting visa in hand was about six months. We were lucky that we didn't have any problems along the way and Australia is a pretty good consulate and quick with interviews unlike some other countries.

Can't really help with the financial stuff, we used my Mother in law as our co sponsor and are again for AOS. I would think it to be safer to use a co sponsor though Unless maybe you moved the money into his savings maybe so he could put it on his I-134? If he is under the 125% poverty line than he can use his savings to make up the rest but i think it has to be three times the difference for the I-134 and five times the difference for I-864 when you get to AOS stage. It says on the instructions though the amount

03/06/12 Interview in Phoenix :).....Approved :D

03/14/12 Received Green card in mail.....

....no more USCIS until December 2013

July 11th is tight, but possible. It all depends on how quickly you have your P3 stuff together as that's the only part you can actually control.

1. It used to be quicker but at the moment the NOA2 is around 5 months. Sometimes closer to 6 months. After NOA2 the file is sent to NVC, then to Australia to have you emailed P3. Once you reply to p3 your interview will be around a month from then. I was one of the people who scheduled my flight and I thought I gave it enough time but it was close! I gave myself a deadline to receive NOA2 and if I hadn't received NOA2 by that date then I was going to reschedule my flight. Turns out I got NOA2 on the EXACT day of the deadline.

2. I would personally have his parents to co-sponsor for the I-134 (the K1 part). Its non-binding and it doesn't really mean anything. It's also a lot safer to have a co-sponsor to make sure they accept it. Then when it comes to AOS and the I-864 you'll have the money in your account (hopefully) from the sale of your house. Then you can use that bank balance to assist with the actually binding I-864. You would show the sale papers of the house, proof it was YOUR house to get them to accept it. If they RFE you for a co-sponsor though have his parents ready (that's a long while off though). The asset thought will need to be 3 times the amount you're deficient in income. So if its just you and her you need $18,387 x 3 in your account.

What is required to be sent/assembled for p3? I've read passport, birth cert and police report. Is that all? How far in advance can you get your report (if I'm anticipating the NOA2 around April, can I apply march/April?), or will they only accept it if it is applied for after receiving p3?

I would apply for it sooner rather than later, I don't know what state you're in but sometimes it can take quite a while to get the report back. I was in South Australia and i applied for my police certificate as soon as i got our NOA2. Make sure that you get the report with finger prints. The station i went to tried to tell me that there was no way i would need a report with finger prints, they were wrong and i ended up having to go back twice. Also, it took about a month to get it back in the mail and it caused a slight delay in sending off my packet three. My police report is valid for a year.

I'll check my email for my P3 and let you know what i had to send off for it

Okay, for packet three you need to fill out DS-230 (part one only), Ds 156K, DS 156 (2 copies). Also form I-134 which the Usc will fill out and supporting evidence. Also, medical, police certificate based on finger print check, DSL 1076 Applicant’s Statement of Readiness to be Interviewed. That's all that was on mine and they will have links to everything in the email also

Finally time for AOS.......

I remember also sending the original and a copy of bothe my birth certificate and my police certificate. you will get the originals back at your interview. Passport and relationship evidence doesn't need to be taken until you have your interview

if i was you i would apply for the police report now, mine took over a month (in QLD) and its valid for a year.. so apply and get it sent to you, not the consulate... :)

Hi all! We have received our NOA2, but not our packet 3 yet, so I am trying to work a little ahead,so we don't get slowed down here. I am a little confused on the police certificate. My fiance lives in VIC, near Melbourne. I am on the Victoria police website right now. Do we need what they call the name and fingerprint check, which costs $137? Or is this something else? Thanks, just for clarification, the national police record should be fine? He doesn't need the federal one, right?
