oh, so just the blind following the blind. i get it.

I don't get your post. Celebs mentioned the gays pushing their agenda now more than ever and I replied in like manor.

I was replying to Celebs in regards to gays pushing their agenda on everyone whether they agree with that sick and demented lifestyle or not.

I do not hate gay people in fact I have gay friends. I just can't stand if they keep ask and it became something unbearable. I remember gay blogger, Perez Hilton, had asked to beauty pageant contestant about gay approval in community and it very clear his intention to do so blink.gif. If people can't accept their sexual orientation, be it. Some lesbians kissed each other on plane and sued the company because they weren't allowed TO DO THAT there. Another thing, for SOME gay people, you'd be a hero if you support them but they've started showing their dislike if you choose NOT to be at their side.

Hawaii has a law that states B&B's may not discriminate against whom they accept as guests on the basis of sexual orientation. This is not a matter of anyone "pushing" anything -- this is the law. If the owner violated that law, the would-be guests may avail themselves of the remedy underneath it. They are almost certainly likely to be within the statute of limitations for this action; it's unlikely an attorney would pursue the matter unless it was. How long it took for them to avail themselves of the remedy may be relevant for a judge to determine the merits of this lawsuit, but we don't have all the details.

Again, if you don't like a law, work to change it. Don't whinge about it -- be an agent of change. Your example of Perez Hilton is not analogous.

I used a B&B once in Penn. it was kinda like sleeping at your uncles house, certainly not a big ocean side victorian, more like a little aluminum sided cape cod on a side street.

Basically what you have is a couple renting out JR's bedroom now that he is gone and "The Law" is so perverse it would insist that this nice couple rent out Jr's bedroom to folks whose bedroom life make the vast majority of people in the world repulsed to think about.... yet the totalitarian among us would insist it be this way.

Most business laws exempt smaller businesses for many requirements..... certainly this should fall in that category.

This is obviously about money and agenda pushing. Were they discriminated against? Yes. Does it really mean the woman should be sued? No. Shut down? Yes.

Why would you want to stay in a place where you were thought of in such a manner. As long as their money was returned and they were given enough time to find somewhere else, why sue?

I understand discrimination is against the law, I understand they broke the law, but I don't think anything of people who are so quick (or in this case slow) to sue people. They got a new hotel. They continued their holiday. They're living their lives. I would have reported them and let it go with them being shut down or reprimanded... but NO they have to get their names in the paper. Pathetic really. That's why the US is known as the "sue S of A", people here are quick to sue, trip at Walmart? Sue. Bad haircut? Sue.

Okay. Can you tell me when Hawaii has a law about it? 2007? 2008?2009? or just now? it was happened around 2007 and they just filed a case recently. If you read my previous post, I am more aware about how people "can do everything" to push their own agenda. If you have a time, you can read a news article about gay son where gay activist rights "do everything" to get support for it. Do you know how power the words can change the world? we have old an proverb here says, words more sharp than sword. That's I took an example of Perez Hilton. People might be don't care but if it repeats many times it would turned out to be a reality bites to everyone.

I have noticed that B&B's in the US are more up market that in most countries.

I stayed in a B&B once...and old Victorian in Astoria, Oregon...never again, it creeped me out. Like Danno said, it's like staying at someone house, you don't get your own bathroom and we didn't even have sex for the fact the walls were paper thin. Screw that, give me a motel/hotel any day.

Hawaii prohibits sexual orientation discrimination by businesses open to the general public. Aloha Bed & Breakfast arguably must comply with this rule even though it doubles as Phyllis Young's home. Ultimately, she's inviting the general public to pay for the privilege of staying at her house.

Her religious objections are also unlikely to excuse her alleged behavior. Religious institutions and organizations are usually the only entities entitled to such a defense under the law. Courts rarely, if ever, allow individual defendants to bypass discrimination laws on religious grounds.

The Hawaii Civil Rights Commission seems to have come to a similar conclusion. Individuals must obtain a "right to sue" letter from the Commission before they can sue a business for discrimination.

The Commission investigated the 2007 claim and interviewed Phyllis Young, according to the Washington Post. She called lesbians "deplorable" and made other negative remarks. Investigators subsequently concluded that it was reasonable to believe she discriminated against Diane Carvelli and Taeko Bufford.

In case you're wondering, that's why it took four years to bring Aloha Bed & Breakfast to court.

Looks like the law has been in force since 1986, though the law has been amended several times since then (most recently in 2006). I can't tell from looking at the bare legislation whether or not the inclusion of sexual orientation has been in effect since 1986 or whether it was added during one of the several, later amendments. Nevertheless, this is the law. You don't like it? Sorry. We can't pick and choose which laws to follow. If you don't want to welcome everyone that the law requires you to welcome, don't operate a B&B.

Why should they sue? Personally, if it were me, I wouldn't. But this is not necessarily about money here -- this is about the importance of upholding the law as it stands. It's about enforcing the law. A remedy is available and these women are availing themselves of it.

What if she decided she didn't want to have any Indonesian guests? The same law prevents her from discriminating on that basis. We are a nation of laws, and proudly so. If you're not happy with how the country makes and enforces its laws, do what you can to change things. Don't just whinge about how unfair it is, and how people should just be able to do what they want. Tough titties.
