Hey I filed for my canadian citizen wife for a I-130 in November. Got NOA1 on November 14th and today got the approval in the mail with decision on December 15th, 2011.

Our wedding reception is in July of 2012 in NY.

Asking fellow VJers, when do you think NVC would get my case and after my lawyer completes all my paperwork, when should i be looking at a estimated interview date. Is it advised that I should go to interview with her because we got married in Niagara on the 28th of October and filed for the case two weeks after. It could trigger something. Please let me know.

What are you worried about it triggering? NVC usually takes about 10 days or so to get cases.

No worries about getting married in Buffalo. They don't really care where you got married, just that you are legally married (and both were eligible to get married) Give it about 7 to 10 days to reach NVC then start calling to get your new case number. I believe Canada has EP, but in any event, you need to get the new case number, then pay the fees (IV and AOS) and then send in your stuff. From the time you send in all of your documents, assuming you don't forget something, it will take about 30 days to get the NVC approval and have the case forwarded to Canada. (time frames are based on China EP so it may be faster or slower in Canada). All in all, your in good shape for a july wedding reception.

Yes, this is what I was getting at too, you can get married where ever and that is not an issue. It would be an issue if you came down to Canada, telling them she was going to visit, got married in the US then she stayed and you filed to adjust status. What you did is totally fine and nothing to worry about. I imagine it being Canada, interview shouldn't take too long to get. :)

uhm....

lawyer?

did he file a G-28 ?

if so, expect to go fast at NVC, as the AOS and IV fee bill arrive at same time.

However,

if yer lawyer is not trained up on the ds-260 (not the ds-230)

and doesn't understand about the online payment portal

and doesn't understand about electronic processing for spousal visa applications at NVC, those headed to Canada

then yer in for a longish wait, whilst you train yer lawyer to get out of 'postal mode'.

i was in the hopes that in about 2 months NVC approves and by april or so i should get an interview date? is that estimate reasonable? i hope im not getting too ahead of myself

Once our case was complete at the NVC (Nov 23) it took them about a week to book our interview in Montreal. They emailed us on Dec. 1 to let us know our interview was Jan 12th. So as long as Montreal doesn't get backed up you should be able to get an interview date by April.
