I was just wondering, in my case..... Say I finally get past the interveiw stage because I provided them with the documentation they wanted. They will in tern give my husband a ban from the country for let's say 3 years (if they are that lenient on him). Do we still need to submit the I-601 waiver for his overstay if he has already been out of the country 3 years....or can he be given his permanent residency straight after the interveiw process is done. :blink:

I-130/I129f Sent: 2008-11-20

Interview Date: 2009-08-11

K3 DENIED Back to USCIS

NVC RFE received: 2010-12-17

PUT IN AP!!!!!!

THIRD INTERVIEW: 2012-07-17

We were denied based on overstay, not misdemeanor conviction.

WE CAN FINALLY SUBMIT I-601 WAIVER!!

Submit I-601: 2012-09-29
