Hello VJ friends!

I didnt hear anything from USCIS for 60 days, and was really expecting my EAD or interview letter, but unfortunally just got a RFE letter! :angry:

Well, i need a help.

This is what they are asking:

X- Submit all supporting tax documentations (W-2s, 1099s, and all supporting tax schedules) submitted to the internal revenue service (IRS) from the petitioner/sponsor on form I-864, affidavit of support, for the most recent tax year.

Well....Now, looking in my husband's filles, i just found all the papers from his tax returns, i found his W-2s, but couldnt find anything saying 1099. I called my hubby and he says that he dont know what is this document. Also, what they mean : all supporting tax schedules?

ANY HELP WILL BE APRECIATED!

hello,

1099 is a form for misc income, that is if your husband received any misc income from his job or employer, example xmas bonus and or incentives. If your husband did not rec'd any then I dont think USCIS will force you to submit something when it is not there. Other options is to have your husband's employer write a letter using company letterhead stating your husband is not receiving any incentives to declare a 1099. I had to file those for mine, that is how I know. Hope this helps.

1099's are also used to report interest (1099int) and income from gambling (1099g), military retirement (1099r), cancellation of debt (1099c) the list goes on.....

He might get a 1099 from his bank or a retirement account, something that pays him interest.

Oh, He said now he is sure that he never got this 1099.

But what about the all supporting tax schedules? What is that?

What documents were sent in the first place? (the USCIS statement is a standard response - if you have 1099's - you would submit them).

Normally - they want your 1040's with supporting W-2's. (or IRS transcripts)

Schedules will mean the various addendum sheets to IRS Form 1040 - (a/b/c/d).

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

We sent all the 1040's, but i can't believe how i forgot about the W2s. :bonk:

So, should i just re-send the 1040s + W-2 now?

Ah - yes.

The 1040's are useless without the supporting docs (w-2, schedules) - so send all the stuff needed.

I would recommend to go with IRS tax transcripts - they are free and have all the info you need.

If you get the tax transcripts from the IRS, it will include everything you need. No need to worry about sending separate schedules and stuff like that. I got a 1099 from my bank for interest earned. I only sent in tax transcripts and everything was fine. Requesting from the IRS takes 5-10 days.

You need to send a complete tax return. What constitutes complete is different for every person. Therefore, we cannot tell you what is complete for you. Most people have 1040 (the return itself) and either W2 or 1099, which report income. Schedules refer to various credits that your husband may have been eligible for (and he fills out a separate form to get the credit - eg. "Schedule A"). He might also have other numbered forms in there. Not everyone has all of these things. We cannot know what his complete tax return looks like. If he doesn't know what his own complete tax return looks like, then it is best to order transcripts from IRS. Tax transcripts include all of the information found in his individual complete tax return.

I found all the 1040s forms that the company we filled our taxes with made it. It was all together, even the w-2s, again, i cant believe i didnt see it when i sent the application...im sooo dumb :(

I'll send this all tomorrow...lets hope to hear something soon.

well, assume for the moment that no one remembers what was filed for each tax year.

have yer uscitizen spouse get an IRS Tax Transcript (see http://www.irs.gov/individuals/article/0,,id=110571,00.html )

and then the two of you study them together .

all forms and schedules used in prior years will be listed in line-item format.
