Timeline

Hi. I submitted I-130, I-485 and I-765 but I only received 2 emails with receipt number for I-130 and I-485 so today I called USCIS and found out the receipt number for I-765 and I checked online and it says,

we determined that this I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION was not properly filed because the application or petition was not signed and the fee you submitted was not correct. Therefore, we have rejected your case and returned it to you, including all supporting materials and the incorrect fee. Please review the instructions on the rejection notice you received prior to re-submitting your case.

I thought I-765 is free as long as I filed it with I-130 and I-485, correct?

The other 2 forms are under initial reviews, so am I only getting I-765 form back?

When I reapply byitself do I have to include the fee?

08/26/2011 - Husband became USC through naturalization

10/12/2011 - We got married!

12/03/2011 - Sent AOS package(I-130, I-485, I-765) to Chicago Lockbox

12/05/2011 - Delivery confirmation via USPS

12/16/2011 - Received emails for I-130, I-485

12/22/2011 - Received NOA in mail for I-130, I-485 dated 12/16/2011

12/23/2011 - Received rejected I-765 due to missing signature

12/24/2011 - Received biometrics appointment on 01/09/2012 dated 12/20/2011

12/27/2011 - Reapplied I-765

12/29/2011 - I-765 has been delivered by USPS confirmation

01/04/2012 - Walk-in biometrics done

01/11/2012 - Received NOA in mail for I-765 dated 12/30/2011

02/01/2012 - Received text/email for I-765, Card/Document Production

02/06/2012 - Received EAD card in mail. YAY!

02/07/2012 - Received text/email for interview date, 03/15/2012

02/08/2012 - Received interview letter in mail

03/15/2012 - Interview at San Antonio, approved on spot and got a stamp!

03/23/2012 - Green card in hand! :^D

It is free. I would just wait until you get the form back to see what the rejection notice was; the online notifications are form-based and likely not accurate.

When you resubmit, you will not have to pay a fee, and you can submit it by itself. Just include a photocopy of the I-797C you receive for your I-485 as evidence of your filing for adjustment and waiver of the fee.

I had the exact same problem well exept, but I sent my form signed on june 29 of this present year and I have a question, when you get rejected in such way does it make the process to be on hold for the I-765 does it start all over thw whole 90 day waiting period or does ir keep going??? Ill be waiting on a ewply plzzz and thank you in advance

Hi, I had the same problem because I sent more money that I had to, in one check, I had to send it back with the correct fee. I-765 is free with I-130 and I-485. My application got delayed though :/

Hey LINAALIYA, how much delayed was it?and do you the whole AOS or just the I-765? THANKS!

Everything was delayed because I sent the applications together, might be different for you I don't know. I sent everything in mid-April and it took them 2 weeks to say it was rejected... Then I had to wait 10 days for my application to be accepted.
