Friends,

Forgive me but I have a raft of questions to ask you because USCIS "customer service" is God awful (though politely God awful). I called with what I thought were simple questions and I couldn't get past the first two. I was told to go hire a lawyer. Nice.

Here are my questions for the VJ community.

1. Do I use her maiden name (from her Visa, etc) or the name (mine) that my bride will sign on the marriage certificate Thursday? I am filling out the adjustment of status document; application for travel document; application/petition acceptance; employment authorization vaccination records, etc., and I don't recall seeing any explanation in the instructions.

2. The 1 civil surgeon I talked to about the I-693 form on examination and vaccination record is insisting on another physical, instead of just reviewing the vaccination record as it says in the government directions. Can he do this? I'll look elsewhere, but he's been recommended by the USCIS for heavens sakes.

3. Do I need to submit the I-797 or the I797C with my adjustment of status paperwork, or should I just submit both?

Use her new name and if her medical has been done in the past year she doesn't need i-693. i only sent my vaccination form and it was fine.

1) What name does she want to use after marriage--maiden or married? Maiden name means the passport and GC match so international travel can be easier. Married means that tickets must be in the maiden name (name on passport) and the GC will be in married name and she MAY have to prove that she is the same person (i.e. carry a copy of the marriage certificate when traveling internationally). If she does not want to use the married name now, she can change it at ROC or at naturalization for no charge.

2) He can do that, but you do not have to have a new physical if within one year. Either explain it to him or find another, but it still may cost you $200+ just to have the shots and everything transcribed. I decided that looking around was more costly than finding a civil surgeon near my doctor and taking one day off of work and having a competed I-693 was important to me, (most of the RFEs at this stage are due to an incomplete I-693 or missing information about the required shots--this one is completely up to you and how much you are willng to spend and your comfort level) YMMV.

3) The I-797C is what we call the NOA1 here on vj. It will arrive after they accept your AOS package and put in into the pile. Are you talking about AP and EAD (I-131 and I-765) I would submit them as there is no cost when submitted with an I-485 and they USUALLY arrive before the GC.

Regarding your questions:

1: Throughout the applications most of them require her married name. Yes, the one that you will sign on the marriage certificate. (Smile) On other applications it should refer to her maiden name as her alias, and the form block will be noted as such. Side note: one of the reasons that you have the alias is for various documents like her passport versus her future “Green Card.” Like in my wife’s case when we got married, her EAD and GC had her married name, but on her passport it still had your maiden name. Thus, if she ever goes out of the country for example, Home Land Security would be able to identify her by crossing the alias with her “GC” married name.

2: Ordinarily, there is no need to conduct another “full” physical. However, let’s say they had written a concern about her medical physical while she was being processed. They may have stipulated that she get checked out for that specific purpose. An example here would be if she was tested positive for TB. If you do not see anything of consequence or concern in her “Brown” envelope, then there is a chance that the physician just wants to make extra money. Check in your area to see if you can find another certified Civil Surgeon, and call them and inquire whether or not they require a full physical.

3: I-797C, Notice of Action

On the 4th Paragraph of I-797C, it states "If you have not already done so, provide supporting documents to assist USCIS in processing your petition and to establish eligibility to remove the conditional basis of your permanent residence. PLEASE INCLUDE A COPY OF THIS RECEIPT NOTICE WITH ANY SUPPORTING DOCUMENTS YOU SUBMIT. Such evidence may include, but is not limited to, the following items:

- Lease of joint tenancy or joint ownership of assets

-Joint mortgage agreement and/or property deed

- Tax Returns

In summary, you will submit a copy of “all” of your “Notice of Actions” receipts. That means everything from your K-1 visa, all the way to your AOS. Remember; only send a copy, because you will need the original for each one at various processing points. Side note: if you have to go to an interview they will take your original, so make sure you keep copies for future reference. Hope this helps.
