You are asking about the options available to you and your daughter. What you choose to do is a personal decision.

When did your F1 status expire?

If you overstayed your visa and accumulated illegal presence in the US you may be subject to a re-entry ban. If you had adjusted status prior to leaving the US then any illegal presence is forgiven. In this instance you have left the US so that may now be an issue.

Now is probably the right time for you and your spouse to consult a qualified immigration attorney to help you sort out the best approach.

I never said I didnt know what was going to happen. I was well informed I could apply from here by a lawyer but not told how long it couldtake. It seem like is up to 5 months on my service center.

If you hold a valid visa you could be able to enter the US today.

Universities do notify USCIS if international students are no longer enrolled. Based on what you state, if USCIS still sees you as "in status" with your F1, then get on a plane to the US now. If USCIS has you as no longer enrolled and "out of status" then you could be denied entry to the US no matter the expiration date printed on your visa.

How do i find out if im still in status? I took leave of absence since she was born

I'm so sorry for your complicated situation! Regardless of your poor daughter's medical issues, you will still need a visa to enter the US again. I would follow suit with what others have said, and have your husband come and get your daughter and then file ASAP and perhaps consult a lawyer as it seems if you got married you may have been out of status and will need some help sorting out the complication. normally, i do not suggest using a lawyer, but I would suggest it with your situation. Again, I'm sorry for that you were mis-informed about the process by USCIS but you can't do anything about that now, and there is no way around coming back without a visa. Good luck to you, and know that there is a lot of help and support here for you. :)
