*My Petition Expired – Can It Be Extended?

The I-129F petition is valid for four months from the date of approval by USCIS. A Consular Officer can extend the validity of the petition if it expires before visa processing is completed.

PLEASE DOES THE K1-VISA PETITION EXPIRES.... BECAUSE MY FIANCE WAS PUT UNDER "ADMINISTRATIVE PROCESSING" AFTER HIS INTERVIEW. MEANWHILE, NOA2 SAYS JANUARY 7TH, 2012 FOR THE VALIDITY OF THE NOTIFICATION / PETITION.

PLEASE CLARIFY MY CONFUSION !!!

The I-129F has been surrendered to the Consulate at the time of the interview, so validity of the petition is not an issue.

Extending the I-129F approval occurs when the beneficiary can not be interviewed before the 4 months following the approval by USCIS.

Your fiance is in AP, which has no defined time limit. When AP is complete and approved, the K-1 is issued which must be used within 6 months to enter the USA.

A consular officer can re validate a K visa petition any number of times for additional periods of 4 months provided the officer concludes that the petitioner and beneficiary remain legally free to marry and continue to intend to marry each other within 90 days after the beneficiary’s admission into the United States.

To have the petition revalidated send a written request to the Embassy that includes a statement of your intention to go forward with the marriage.

In Arizona its hot hot hot.

There are 2 times when a K1 expires. At the embassy if you delay the interview and if it is returned to the US after an interview where the visa isn't issued.

This will not be over quickly. You will not enjoy this.

You must schedule the interview prior to the expiration date. You did. No worries.

MANY THANKS TO YOU ALL.... THE CONFUSION IS CLEARED BUT DO WE NEED TO SEND REVALIDATE THE PETITION WITH A WRITTEN LETTER (as said by "bigdog") ?

No. You would only do this if the interview were delayed. The petition expiration no longer applies to you
