We applied for I-130 last year, everything went easy and smooth until we got Visa Denied in Colombia Embassy.

After about 1 year waiting and RFE approved our I-130 is being sent to NVC for processing again.

My question is:

Will we have to Pay fees again, fill forms again and return packages again with NVC?

Will our time frame be the same as others, slower or faster?

Any difference for being the second time?

How long is the Usual process time for an I-130 in NVC (BUSINESS DAYS?)?

How long is NVC closed for Christmas?

Sorry for so many questions, new to this forum and will most likely stick along while my process is finished! Thanks for all and any help!

Yes, you have to pay the fees again.

As you can see by waiting for NOA2 for 1 year your process is not different.

NVC takes as little as 3 weeks and sometimes 1 year. If you have all your papers and no RFEs and pay fees quickly then you will get done quicker.

I hope you have addressed the reasons why your first interview you got denied.

Your interview might be harder this time, might be easier.

NVC is a government agency so they will probably be closed for just one day in December.

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

Nov 30, 2011 Notified of Interview date

January 19, 2012 Interview- 240 days from NOA1

INTERVIEW RESULTS-APPROVED WITH 14 WEEKS AP--but he got his visa in 56 days!!!!!!

The reason for denial was because they thought our marriage was "setup", not enough evidence (we didn't know we could take any evidence to interview).

Hopefully this interview will go smooth.

We received the notice of approval of I-130 on Dec. 15,

and as i've read here I suppose i should get a case number within 7-15 days?

What will be the next step after receiving case number? And how long after receiving case number does it take?

I think the case number is taking about a month lately for NVC to assign it. But sometimes it is just days.

So, you have to call NVC everyday.

Ask for....

NVC case number

NVC IIN number-INVOICE NUMBER

***Give BOTH emails

After you get case numbers then

send them the 3025 by email to nvcinquiry.gov and make the USA citizen the agent of choice cause everything will go smoother.

Then it takes a day or two to get into the online payment portal https://ceac.state.gov/CTRAC/Invoice/signon.aspx

Pay 864

next day send 864

and then IV payment should be ready so pay it the same day you send 864

next day send DS-230 or IV

Wait for RFE's or case closed.

Also, this is the time to send MORE evidence if you need to. So send more evidence only if you think you did not send enough with I-130. Send the new evidence with the 864 or 230 papers.

What evidence did you send with 130? And why did it take a year to get NOA2?

WOW...alot of stuff... I remembered i filed for this about the same time a year ago... but it was all handled by immigration counselor that helped us step by step..

We sent to USCIS on our RFE:

-50 pages of texts between us

-Letters from family/friends

-Emails (around 15)

-Photos (around 30, Wedding pics)

-Skype pictures (around 20)

-Plane tickets to visit in Colombia (4)

-Parcel receipts (2)

-Money wiring (2)

-Christmas/Birthday cards

-Some written love letters

Our Time line is something like this, from 1st appointment:

March 11,2011 - Appointment US Embassy (Denied for Lack of Evidence)

May 12,2011 - USCIS Received Case Back From US Embassy in Colombia

September 16,2011 - RFE Notice (30 days to respond)

September 30,2011 - USCIS Notifies us that they've received evidence and is under review

December 15,2011 - RFE Approved (case being sent to Department Of State)

NVC IIN number-INVOICE NUMBER

Do we get this forms by E-mail, mail: ???

Did you actually receive a denial slip for the Visa at the interview? Or did your paperwork get sent back to USCIS for further review. I don't understand about the RFE if the Visa was denied at the interview.

Was told by Immigration Lawyer that since is second time around in NVC process will be directed to consulate after NVC receiving it... Also a representative that we called in at NVC told us we wont have to be doing any paperwork after they receive case...

Anybody been thru this process before, after an RFE approval from USCIS?

Yes, your immigration counselor (lawyer) is correct. The NVC will simply record in your file that the I-130 petition was reaffirmed by USCIS. This removes the possible "P6C" marker (paragraph 6C of section 212 of INA) from your file if you hadn't replied to the NOID/NOIR RFE notice from USCIS in time or USCIS didn't accept your evidence. The NVC then directly forwards the reaffirmed petition to the foreign embassy. Sometimes (depending on the embassy) a new case number will be assigned. No further fees are due at NVC, nor paperwork needs to be submitted. Usually NVC forwards the file within a few days. As far as I recall, the next notice you get is a letter to the beneficiary from the embassy with an interview appointment. If the beneficiary has moved, be sure to contact the embassy now with the new address (an address change with USCIS does not automatically transfer to DOS). If more than a year has passed, expect to get a new police clearance, medical exam and updated I-864 AOS for the interview. Good luck with the next interview (you should have a much better chance this time!)

10/12/10 Interview rescheduled to 12/3 10AM, waiting for children's NVC CC

10/25/10 Sent I-130 for children to Chicago lockbox, NOA2 1/25/11 online
