Hi everyone,

Quick question regarding specific supporting documentation.

Brief background: I came to the U.S. ~11 years ago. I completed by undergrad here (2000-2004), worked in the U.S. and recently finished up my MBA in the U.S. (2009-2011). I am currently on OPT expiring in July 2012. I got married to my wife (U.S. citizen by birth) in November 2011, and applying for AOS now.

Q1. For form I-485, is it advisable to include all my EAD cards and I-20's? I have 2 EAD cards from undergrad (expired) and grad school (current), and about ~8 I-20 forms (3 from grad school, 5 from undergrad - since the I-20 expires every year). Should I include all of them? Has anyone been in a similar situation?

Q2. On a similar note, on Form I-485 when it asks for Current USCIS Status and Expiration, I have put down F-1 OPT and the Expiration Date on my OPT card. Is this correct? Should the expiration be what's on the F-1 stamp (expired May 2011), the I-94 (which just says D/S), or OPT card (July 2012)? I would clearly want to put down the last one but just want to get confirmation.

Thank you for your help!

I would add copies of all I-20s and EADs issued to you, because they are proof of you maintaining legal non-immigrant status throughout the time you've spent in the US.

Expiration date on your EAD card issued for this OPT is the date I'd put as the expiration of your current USCIS status.

Well, you are exactly same as my husband's profile, we send the copy of EAD and current I-20, not all I-20s.

2. Yes, I guess expiration day is on current EAD card. Good luck.

I lost my old I20, but I have recent I20, is that OK for me to submit only the copy of my recent I20 for I485?

I want to confirm this point?

Thanks!

The purpose of any of those documents for I-485 is to show lawful entry to the U.S. The most important is the most recent stamped I-94 (assuming you've made any trip out of the U.S since you entered) if not your original I-94, followed by any recent entry visa stamp you may have on your passport. You should be fine even without submitting an I-20 as I did for mine. If you just want to play it extra safe to relieve anxiety just send a copy of your most recent I-20 too.
