illegitimate children but has marriage cert of the father and a mistress

Father wants to petition 2 illigitimate children. Father is married to his first wife and still married with 5 kids. But father got a mistress and he married the mistress. How the father can petition the daughter and son? Can they use their birth certificate and submit the mother's marriage certificate although their marriage is not real (Coz the father is still married with his first wife)..

Father doesnt know what to do coz the birth certificate of his daughter says that her mom and dad are married.

Father was petitioned by his legitimate son from the first wife and real wife. So Father wants to petition daughter from different mother.

please advise. Thank you.

How did this happen?

Petitioning an illegitimate child/ren is allowed in the US immigration law, the only problem is if wants to bring his "current wife" with him. I am not sure what's the effect of the "married" status on the BC of the children if it has any bearing at all.

Best to see an immigration lawyer on this case specially if the father was petitioned by his son as "married" and the wife that was indicated there is his mother. But no matter what, do not conceal any information. You know, if you start with a lie, you have to cover it with another and multiple lies.

sounds like opening up a can of worms. as has been suggested, consult an immigration attorney.

NVC Case COMPLETED: 2011-12-07 ( 43 days from NOA 2 and 65 days from NOA 1)
Interview Date(Lagos): 2012-01- 23
Mom was late for interview
New Interview date: 2012-02-29 : VISA APPROVED

How can he be married to two women at the same time.... US does not recognize such arrangements.
