i-131 qualify for advance parole

Hi all,

I am now applying for AOS by submitting i-130 and i-485 (along with health form and affidavit of support and g325a)

I am also submitting Employment authorization and Application for travel document.

On form i-131 Part 7: On a separate sheet of paper explain how you qualify for advance parole

Do i need to attach a special letter? Does submitting i-130 + i-485 qualify me for advance parole.

If I do submit the letter what should I write on it??

You don't need any particular reason for the AP, it is routinely issued when applied in conjunction with an AOS application. If I remember correctly, I did attach an explanation of some sort - but it was something very round-about and short. I don't think you need to necessarily explain any details, the AP will be approved whether or not you have trips planned.

I don't know your situation, but if you've overstayed at all, don't bother with AP. You may receive it, but you won't be able to use it.

I dont exactly know what you mean by overstay. But I am still on a valid F1 Visa and have work permit as part of Optional Practical Training.

Then you wouldn't have an overstay. An overstay is when your visa expires and you continue to stay in the country, accumulating days of unlawful presence.
