Family says attack on Muslim man in Tomball should be hate crime

Yaqub Bham's visit to a residence in Tomball on Wednesday was supposed to be routine for the 61-year-old ADT salesman, who had come to inspect a client's property before installing a home security system.

Instead, the homeowner, David L. Nienberg, allegedly tried to stab Bham with a fork, bit off part of his ear, and beat him so badly that he broke 10 ribs.

Nienberg, 42, of Tomball, is charged with aggravated assault. If convicted, he could serve from two to 20 years in prison.

Bham's distraught family members want the incident investigated as a possible hate crime against Bham, a Muslim native of Pakistan who became an American citizen in 2007.They say an agitated Nienberg became violent after asking Bham about the origin of his name and where he was from.

Harris County sheriff's deputies who responded to a 911 call from Nienberg's family about 5:50 p.m. on Wednesday did not mention the questions about Bham's name and origins in their report, said Deputy Thomas Gilliland, spokesman for the Sheriff's Office.

Gilliland said Nienberg apparently became angry while reviewing the contract for a security system in his four-bedroom home on Everhart Pointe Drive. When Bham offered to make another contract, or change it, "the defendant took the backpack that Mr. Bham had and wouldn't give him the backpack, which contained the keys to his vehicle," Gilliland said.

The two men's verbal disagreement then became physical, the deputy said.

Nienberg lunged at Bham with a fork, Gilliland said he was told. Relatives took the implement away, but Nienberg allegedly managed to get Bham in a choke hold, beat him, and bite him while muttering about military operations.

When deputies arrived, Nienberg refused to let go of Bham until they "secured the perimeter" and "secured women personnel," Gilliland said.

It took three deputies to pull Nienberg off Bham, he said. They deployed Tasers on Nienberg twice, and even then, the furious man continued to kick and spit after they wrestled him into a patrol car, said Gilliland.

i love the weaselly way the cops are falling all over themselves in the article too, grasping to find some kind of ptsd or under the influence of drugs or alcohol excuse for the guy, because that's just so much easier to grasp than that there are some really sh1tty people around who do this kind of thing all on their own. and why were the questions nienberg asked re. bham's name and origins not included in the police report?

You seem to be really "reaching" here, from all the details given, it seems like mentally disturbed person attacking an innocent guy who was just trying to do his job.

It could be the reason the inquiry made about the victims name never made the report was because it never even happened but the claim surfaced after talking to family members about how to make a legal case.

Or maybe he did mention it to the cops but the old guy seemed so batty that an attempt to determine a logical motive for the attack was not going to be relevant in this type of case.

Trying to determine the thoughts an intents of crazy people seems a bit silly to me.

At least 3 people were killed. There was no immediate claim of responsibility for the attack. Suspicion is likely to fall on al Shabaab rebels

it's a pretty big anomaly, as far as mental illness goes, to never show a sign of mental illness, and then suddenly have a violent break like this and bite a man's ear off, break 10 of his ribs, and bite his tongue nearly through in three different places. it's far more likely to be due to his unmuslimness, obviously...

i in no way think it's anything to do with vermont. in fact i rather like the place, but sometimes it gets annoying having vermont crammed down one's throat all the time. great syrup though. decent cheese.

Hey Vermont was just selected AGAIN as the "healthiest" state, 7 of the last ten years. Big reason? Virtually non existant crime, even against Muslims. It is the safest place for Muslims to live in this country (and women and children) but you say that is "cramming down your throat" Strange.

Still number 1. I did not say it was perfect, I said it was the voted Healthiest. It was.

But we can address those issues

1. Not sure, possibly because the state is so rural but I would consider that a lazy excuse, Burlington has exceedingly good health care facilities and it is within a 3 hour drive of any place in the state. No excuse. Not a threat to Muslims unless they just do not get ther kids vaccinated. We have state health care based on income and we will single payer healthcare in 2014. If kids are not vaccinated, the parents need to get it done.

2. Vermont is heavily agricultural and those are dangerous jobs. Between farming and timber...all dangerous work. This is predictable. On the job death exceeds homicide by a factor of 15! But then our murder rate is extremely low.

3. I never drink but college graduates are our number 1 export (in economic value). Burlington has a total population of 42,000. 12,000 college students. We have a high prevelence of college students! Not to mention Middlebury, Northfield, Johnston, Barre, Bennington...all heavily college student populated. Not an isse that affects Muslims walking down the street.
