TN Status to GC - EAD and AP Questions

I am a Canadian, working in NYC for the past 3.5 years on TN Status as a social worker. I just married my American husband last week and I'm getting our Alien Relative Petition (i130) and AOS (i485) ready to send off but I have a few questions about the EAD and advance parole. If anyone can help me that would be great!

For the advance parole (i131) the application type is D right (applying for advance parole to allow me to return to the US after temporary foreign travel)? If I'm adjusting my status from inside the US and currently have TN status? Basically I don't have any travel dates (until a friend's wedding in July) but I want to be able to travel to and from Canada to see my family and god forbid if there is any family emergencies. I've read that it's pretty standard for them to grand the AP even if you don't have specific dates but does anyone have a template of the letter they used to attach to explain why they want advance parole that had a similar situation to me?

With regards to the EAD (i765), for people that have TN (and are going to keep their current job)did you include an employment letter? The way the instructions are written for the i485 it sounds like you only need to include one if your adjustment of status is related to an employment visa, but my adjustment of status is due to my marriage. But I read that at least one person on these forums that was working here on TN got a RFI for the employment letter. If anyone that has TN has submitted an employment letter, do you have or know where I can find a template?

June 2007 - J1 Student Work and Travel

June 2008 - TN Status (Social Worker)

April 2009 - Renewed TN Status (had a 1 year term)

March 2011 - Renewed TN Status for expiration (had a 2 year term instead of 3 because my passport was going to expire)

June 2011 - Renewed TN Status again for job promotion :) (still a social worker :)

2011-2012 - Planning on getting married and apply for green card :)

You don't attach a letter to explain why you want it. As you're applying with AOS that's your reason (it's in the instructions). For the date, put the date when you want to go back for the friends wedding, tick multiple trips. Most people just write "unknown" but seeing you actually have an event it won't hurt... hopefully you'll have your GC by then anyway.

I don't think you need the employment letter for YOU (it's not a requirement for the I-130 as you said, you're AOSing based on marriage) but the USC does for the I-864.

I don't think I need to include anything about my income or job for the I-864 (Affidavit of Support) since my husband's income is well above %125 of the poverty line. In the I864 instructions it says that if I'm including my (the immigrants) income as support then I need to show that I will still have my same job after I get my green card. But since our household is just me and my husband, his income alone should be fine for them to look at.

Again, I'm curious for the employment letter specifically for the Adjustment of Status. Anyone who has TN that has gone through the process able to shed some light? Thanks.

The immigrant does not need to send an employment letter, unless for the purpose of using that income on the I-864.

8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!
