EAbbas I know just how you feel. The system is letting us down and it's not fair. I have a friend who's fiance was in AP for 4 years in Pakistan only to be told her K-1 petition had expired. I don't know how those people at the embassy in Islamabad can sleep at night. They must not believe that one day they will answer to God for the heartbreak they cause.

My husband spent 15 months in AP and now after being reaffirmed he is in AP again so I understand how bad it hurts but all you can do is just be strong and take things one day at a time.

ok guys... you all know me well.. you know i dont complain too much or whine or cry about this process.. but right now, today.... im feeling heartbroken like they simply dont care about us... like everybody elses reuniting is more important than those of us waiting for so very very long... ive missed my whole first year of marriage... now im missing my whole second year... i just had some good news with my job and yet i have to call my husband and tell him instead of meeting him at our front door and celebrating going out to dinner. When the kids are sick especially KAte... it should be us both taking care of them and yet its not its just me with him worrying to death about them during their illnesses...

we shouldn't have to eat together on the cam or have him wake me up saying good morning jaan on skype... there should be no blown kisses into the air and no wishing to hug... this process is failing us and im literally broken i cry almost at everything now the children cry for him he cries when he doesnt know that i know... and its not about usa its about us being together.

i hurt literally for him i hurt for the time weve lost i grieve for babies we could have had and vacations together and sunrises and sunsets sipping tea... i ache for tripping over his feet or picking up his socks or laughing when he thinks i say taco man instead of tuck them in the bed...

This is not fair now... i was ready to accept 9 months but now at almost 14 months its breaking me into pieces... and the only thing to put my heart back together is my husband to hold me again :crying: :crying: :crying: :crying: :crying:

After 17 months in AP our case has been denied.

I received the email today after I inquired about my status from the CO.

The CO's reason was word for word : " Unfortunately, we are not convinced that your relationship with ------ is genuine and will lead to a life-long marriage. Therefore, we returned your petition to NVC for them to return to USCIC for revocation. We will return all your documents to ----- shortly.

When I visited him and went to see the CO personally last year, I asked her what the problem is and she looked at me and said she has a GUT FEELING that our relationship is not real. That's it. A gut feeling. We had 12pounds of supporting evidence which she said was too much to look at.

This process is absurd.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Renewal application send for EAD/AP : May 31,2016 (AOS pending over 1 year). Received June 2, 2016,Notice date June7, 2016, emails,texts, NOA1 hard copy

Service request for pending AOS April 21, 2016, case not assigned yet.
Service request for pending AOS June 14, 2016, tier 2 said performing background checks.
Expedite request for EAD/AP Aug 3, 2016, Aug10 notification >request was received, assigned, completed. RFE letter requesting evidence for expedite, docs faxed Aug18

*Service request for I-485 Aug 3, 2016, Aug11 notification> request was assigned. Service request Dec 2, 2016.
AOS Interview letter received Aug 12, 2016

AOS Interview September 21, 2016.

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Second Biometrics completed Aug 17, 2016

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

I am also very disillusioned. They are rendering decisions based on profiling and pure discrimination in my opinion. I think they have a good idea right after the interview if they will approve or not. They are punishing people by making them wait. They want people to give up. They sent my case back after 3.5 years saying it expired. That link said my Visa was Issued which they confirmed was false. I am sure they sleep at night thinking they have saved humanity from one less failed marriage or fraud. I find it particularly funny that they don't think you will have a lasting marriage. What about all the US citizens that are divorced? There are no guarantees. Why didn't someone stop them before they married and say they had a gut feeling it would not last anyway. I feel deceived and mislead by this Visa process. Just call me Bitter Betty! I sent a letter to the US Embassy in Islamabad asking them exactly what evidence they would accept that proved a relationship if: 9 affidavits, 5 visits, pictures, phone bills, wedding deposits etc., did not do it. I never got a response.

I bet there is a complaint box inside the embassy probably hidden behind a vending machine. I can't say for sure about every government agency but majority of my professional career has been spent working government jobs and there is always a path or channel which complaints are to be directed . I can't say I agree with everyone's view of the interviewing agents as the bad guys, they also have to justify by documentation of opinion. We also have to take into account many years of abuse of the system. I personally met and know 3 very wonderful women whom were taken advantage of and left with broken hearts promises and children when the honesty of just wanting American citizenship...still makes me sick thinking of what kind of animal would do this but that's the reality of it all. Thanks to the few rotten apples the whole bunch suffer. Btw if anyone wants to take there anger out on this broken system I could accidently give you some addresses of people who broke it feel free to go ask them. : )

As long as I know what is true in my heart I will remain strong and I encourage every one here and others who are not on this forum to remain strong with your head up high. However my hope remains that we will all make it and that we won't let this broken system break us. I refuse to be trapped in a document driven system of someone to tell you that your not in love. Perhaps we should try and brain storm some ideas of possibly locating a resource that could actually HELP and not the phone number to the embassy that leads to no more then another daily pill of endless hope.

Do we know of any Senitors that have some sort of connections?

How about contacting the embassaidor of US to Pak?

is there an ombudsman that will interact between embassy and applicant?

somem individual who feels they have some sort of responsiblity to resolve these issues?

You can write a complain to the Inspector General's office not sure what that will accomplish. But I do agree that we should take a stand against this broken system. Even if our loves are granted a visa. Just so no else has to go through the same hurdle. This broken system need to be fixed. As for those who are going through the stress caused by the system and feel let down. It is perfectly okay to vent out your furstration and there is no better place to do that than this forum. Here we all can relate to one another. So thank you EAbass for creating a place where we are able to connect with those going through the same struggle. The other day I was feeling down and frustrated it was nice to be able to here and vent, knowing that my bothers and sisters would understand how I feel. We are all here for each other and there is no one that can tell us that their gut says our relationships with our love ones are genuin just because we do not meet some sort of guidelines. Stay strong and keep faith. I strongly believe that Allah will grant our prayers we just have to keep faith.

Does anyone remember the Million Man March upon the Capital. It is an election year and if we gathered and showed the government in vast numbers the families with broken homes due to our system maybe we could attract some news media. This just an idea that is running in my head but this is all political. Yes, I agree the CO job is to eliminate the fraud and protect people but they need to at least listen to those of us that are true and not take years from our lives. Life is far too short and they are trying to make us give up yet they are giving amnesty to people that came here illegally and are on welfare. While we did everything legally and proved that we are not a public charge. Where is the justice in all of that? There is NONE, it is just to get more votes for re-election.

The system is broken and that's the bottom line. To have to spend years in AP just to find out your case is denied or expired is just wrong. In my NOIR it said the CO from the first interview developed reasonable suspicion that the relationship between the beneficiary and petitioner was not bona fide. The NOIR doesn't say what her suspicions were.

I think my husband and I have a right to know what her suspicions were based on. Was it a gut feeling she had or was it something my husband said during his interview? We will never know. They are supposed to be looking for fraud and abuse of the system by the beneficiary but there has got to be a better way then making people spend years in AP. The stress it causes families is unbearable.

During our 3 year visa journey we have had to watch other couples from inside and outside Pakistan get their visas. They are able to get on with life while we have been stuck in limbo. We were blessed and were reaffirmed but to what end? We have to go back through Islamabad embassy and face AP all over again. I dread knowing that our case is in AP again. How many years will it take this time? Will the end result be a visa or will we have to appeal again.

I have friends that keep asking me how many more years of my life am I going to waste trying to get my husband here? They really feel that I am wasting my life. It hurts me when they say that. I love my husband and I just want to spend the rest of my life with him.

this is the sad reality if a normal marriage fails its nobody fault but if a marriage involving immigrant fails they say it was for immigration lol

Oh dang. I am so so sorry Ebunoluwa. It is heartless and well "gut feeling" really. Oh I could say so much about that CO. But don't want to get booted off of VJ. Know you are in my thoughts and prayers. Don't give up fight fight fight you will be victorious.

I have been AP for over 8 month and embassy didnt replay any of my email or phone calls .... i ask them about my passport 3 times to send me back my passport buz my passport will be expire in dec 2012 ..... and still waiting for my passport not come yet i feel so misble and sad feel like why they doing that with us and why they keep us apart from each orther like that i guesss they wants to everyone die to be apart from each orther :((((((

I did some research today and that INA 221g which are the guidelines for AP to question fraudulent cases. Which of course we already knew. This is under the discretion of CO, but lately it has been abused. There are also cases where the COs have shown racism towards individual cases. Yet no has been reprimanded them for their actions. This leads be to believe that powers to be are condoning such actions by the COs. Immigration lawyers have filed petitions against the abuse but our government officials have not taken any actions to rectify the issue. I say we continue to call our elected officials and make our voices be heard. Those who scream and shout get heard and those who stay quite just let life pass them by. I have already contacted my senator's office and will continue to call them until our case is approved.
