Hello all,

I have been a silent viewer of this thread and I feel that I can relate to a lot of people here because I have been trying to bring my husband back to the U.S. for the past 6 years. It has been a volatile journey and a very tiring one as well.

I wanted to share some of my experience with some of the people here because sometimes you think you are going through this alone but I want you all to know that there are people like me who have been struggling for years and have not given up hope.

My husband came to the US in 1999 on a duration of status student visa. He wasn’t able to continue with his education and due to his special circumstances he applied for an asylum petition which was referred to a judge. He later withdrew his petition and took a voluntary departure. Meanwhile, we met and decided to get married here in the U.S. before he left for Pakistan. At that time I was only a green card holder so when we filed our I130 in March of 2006 we had to wait till December 2010 for his consulate interview. While our case was pending, I went to visit him every other year which meant I couldn't advance in my career because I had to leave my job every time I went to Pakistan.

Finally when we had our consulate interview in December 2010, my husband's visa was denied due to illegal presence of more than a year in the U.S. We were told we will need to file an I601 waiver but when we consulted with lawyers here in the U.S. we were told that he does not need a waiver and should be issued a visa as he never accumulated any illegal presence due to his "duration of status" student visa.

We filed a Motion to Reconsider with Laurel Scott, one of the very reputable lawyers in the US, but Islamabad refused to acknowledge it. For several months we tried but at the end, we hired a local attorney and filed our I601 waiver. Meanwhile, we have a 2 and half year old daughter that had never met her father because I wasn't able to visit due to my job. Finally, I took her to see her dad earlier this year while our waiver was still pending.

Our waiver took 1 year to process and in May 2012 after all this time we were told by Bangkok that a waiver was never needed and that they are going to ask Islamabad to reconsider issuance of visa.

Islamabad is now in the process of issuing us a visa and they have requested for new medical exam as well as a new police certificate. We are hoping hubby will be here soon. I hope it is before November because that will be our 7th wedding anniversary and so far, we haven’t even spent ONE of them together.

Those of you who are going through this situation where you are waiting for your spouses to join you, please remember people like me and my hubby who have a journey that is spread over years and it might offer you some comfort and hope that there is an end to it. Be strong and you will get that good news soon!

They don't ever ask for any of this unless they are finishing the case. As for the pcc... im sure its expired... i would go ahead and get one done just in case.

Wow... what a story full of trials and struggles with such a happy ending!! thanks for sharing your story... there is indeed so much pain and heartbreak for those struggling and waiting for month after month that those that never dealt with could possibly understand. I pray your life is happy and blessed always.. and yes i pray to that this month of Ramadan brings blessings on us all...

No post for Student Visa here... I am sorry if this is the wrong section I am posting here because people are communicating. Please share your experiences if you applied for student Visa or have some knowledge about it.

I was interviewed on 23rd July 2012 (5 days huh) Visa officer was friendly, he took my passport and put me in AP under 221g (atleast I wasnt rejected like every other student). I am very worried because I must report to my college on 27 august 2012. Otherwise I will need to defer my admission to the next semester and get a new I-20. I am going to 4 year BFA in Film and pretty excited at the same time.

I have a friend who got his passport after AP and total time taken was 9 days. Now there is just a white slip that I have in my hand which doesn't has any case no. or reference no. and I am stuck. I have been to Boards with AP and they are scary. Upto one year.....

Please reply and pray that I get my Visa Asap....

I wrote to the President's office and explained my denial and I only received the basic following form letter back. I guess that I won't be getting help from his office. :( I am trying everything I can.

You are our first student visa poster! Im not so familiar with the student visa process but what I do know is ISlamabad is very unpredictable and you won't really know anything until it happens. You hear they kept my passport and it's good news the visa will be issued soon but they've had my husbands passport over a year.

I wish I was able to give you really positive information but all I can say is as long as they didn't request more documents then they will work on your case without having to wait on the other docs. Depending upon what they have to do it can take just a few weeks or months or like a few of us over a year. Because you're not immigrating i'm not sure it would take so long but the fact you will be here for several years they may do deep background checks on you anyway.

Just watch your emails, phone calls etc.. maybe they will contact you in time to start your semester at school!

its mean that my case is refused and i cant get my visa now?????

Mine says the same... no worries.. i think they created this AFTER our interview so it may not show the same thing. I called DOS just friday and they told us everything was fine with our case they just havent finished it. That was july 27. If it was denied they would have told me. The fact it doesnt have a creation date and the fact this was just implemented may be that previous interviewees of a year ago may not have the same info the ones now will.

Remember there are a lot of ppl they have to upload cases into this system and i refer to our 221g paper as it stated and it says that AP is mandatory... (background checks)

You are just delayed... just be patient.

9/9/2013 Responded to NOIR/USCIS received documents awaiting response

9/20/2013 USCIS reaffirmed sent to embassy

1/04/14 Case opened for review

8/31/15 Interview- no questions visa approved on the spot

9/8/15 visa status issued

9/10/15 visa received

9/19/15 POE Charlotte
