Just wanted to stop by and say that all of you are in my prayers for a speedy approval. Some of you know my history and we are very thankful for all of the advises. I can`t imagine the pain that you guys must be suffering over this process but believe me I wouldn`t know what I would do if I were in your shoes. If you guys need to talk I`m here. Just because my wife is here doesn`t mean that I`ve forgotten about you guys. In fact I check here from time to time to see who I can congratulate and extend my wishes to. Inshallah Allah loves us all and I have faith that he will do whatever he can to make you all happy.

Sorry for being a stranger, folks... I've been caught up trying to expedite the passport renewal process, bickering sometimes with officials in Quetta and sometimes in Islamabad... but after much toil I finally got me renewed passport and sent it today back to the embassy with me new medical reports.

Oh, the lovely told me an interesting fact today... she received a letter from the Senator's office (who we requested to make an enquiry on our behalf in early January) saying how when they spoke with the US Embassy in Islamabad, they were told the embassy is waiting on my renewed passport and the medical reports. No mention of AP at all... gotta thank Emmy, Carolyn and everyone who helped me for your insight into the matter when I asked you ladies what could it possibly mean when I was told they were asking me to renew me passport and send it back asap in regards to AP.

I'm praying now they'll issue the clearance soon... AP is evil, pure and simple.

I hate you AP

You suck... AP

Administrative processing is what they call you

I call you administratively crappy.

Timeline

I filed the Writ of Mandamus today in Federal District Court. Baised on my low income I asked the Court for a free lawyer to handle my case. I am waiting for a decision about that. I should know somtime next week. I am suing the Department of State and the FBI.

I am both nervous and scared about the lawsuit but I can't stand the thought of spending more years in AP. Please everyone pray for me and Ahmed.

I am very proud of you. This has been a horrible road for you both. I will pray for you and I hope the case goes by quickly and he finally gets the visa.

Did you email the embassy or call the ombudsman at USCIS first and tell them you will file a writ? I am curious because I seen someone else say to do it and then the ombudsman will make your case get an answer quicker but I do not know if there is any truth to it.

I do not know when your original interview was cause your timeline stopped. But I see on the tracker the 2nd interview was 8 months or so ago.

Just keep us posted on any updates you have... keep good notes as well and when the time is right you may want to put a thread out there on how you did it and what you had to do to complete this process so others can benefit from your knowledge. Wishing you only success in this and praying his visa is issued soon.

I have to prove to the court that I made a reasonable effort to get this matter resolved before I filed my lawsuit. I wrote letters to David T. Donahue, Deputy Assistant Secretary for Visa Services, Bureau of Consular Affairs at the Department of State. I wrote to Barbara L. McQuade, United States Attorney and I sent an email to the embassy informing them that if my case was not finished in 30 days I would be filing a lawsuit.

My husbands first interview was in July 2010. We were asked to submit additional documents which we did in November 2010. Our case was placed in Administrative Review for 3 months then placed in Administrative Processing. In May 2011 my husband went in for a second interview and we were placed back into AP. In January 2012 they did a field investigation on my husband and we are still in AP. So we have been in AR/AP for 15 months.

The stress of the visa process has taken a heavy toll on my husband and I. I filed the I-130 petition in October 2009. We had many bumps along the road that slowed us down. We have been on our visa journey for 2.4 years.

It's a long letter and says that they are sensitive to the fact that the purpose of the immigrant visa program is to re-unite families. Nonetheless, The U.S. Embassy Islamabad, like all U.S. embassies and consulates, must adjudicate visas in accordance with the provisions of the law, and, in some cases, this involves extensive administrative processing. They assure me that the Embassy and the Department of State are aware of my concerns and will do all they can to see that the visa is adjudicated as soon as the processing on my husbands case has been completed.

I just wanted to share this letter with you guys who might want to write to the State Department about your case.

That's somewhat comforting to hear, that Dept. of State reacted to you. I hope your husband gets approved soon.

It's unfortunate that most Pakistani guys have to go thru. the AP process, but, that's the way it is, given Pakistan's political situation, level of anti-American feelings from that region of the world so the US government needs to their due diligence.

Hang in there.. I don't think yours is an isolated case. I personally know three guys put on AP for K1 visa.. it's been over 10 months for each of month. :(
