So we're in the middle of the removal process and my husband has to renew/extend his driving license. We sent in all the paperwork they requested in the initial form and now they came back asking for a copy of the I-94.

Who here has gone through the license process so far and did you have to send this?

They are confused. They don't realize that he is a permanent resident not a temporary resident. He should go in person with his green card and the extension letter and if the first person he talks to doesn't understand, then ask to speak to a supervisor. He won't have an I-94 as he is a permanent resident.They should be able to extend his license for the validity of the extension letter.

I concur with the replies. There is absolutely no reason or need for them to ask a PR for I-94. What if it was taken during the AOS process, which usually happens during interviews. I think you should go in person and hopefully come across a different official who may not ask for it. Or maybe they didn't have a look at your status and think you are still not a resident.

I'm thinking from the OP's 'about me' that the OP is in California? I agree with others that the DMV likely don't know the OP is now a PR; particularly if they initially got their license while on a visa. Perhaps while they were a K1?

I have a CA driver's license that I got back when I had my work visa; that was issued for 4 years (2 1/2 years longer than the visa was good for). When I went to change my name I had my green card ready to show them but all they wanted was the wedding certificate, even though my visa was expired by that point. I guess when I renew my DL next year I likely may get the same mailing. You could mail in a copy of the green card with a letter saying status has changed... Worth trying to avoid a trip to the DMV! :blush: Then again I know someone else who applied for a CA DL with a GC and the DMV person took the GC away for 5 minutes to check it was real and run tests on it. So maybe a trip to the DMV might be the fastest solution! Let us know how it goes...

Thanks so much all; you're right I'm sure they are confused as they gave our son a full term license when he got his which we thought was odd but didn't want to rock the boat!

Husband is going to go down at the butt crack of dawn next week and talk to a human....wish us luck! :wacko:

Oh wow that's horrible. :( So what happens when the card expires? They didn't take the one year extension letter into account?

I guess thats a standard policy that they apply at their discretion. My first DL was issued for 5 years while on AOS, whereas the DL's in the State of NY are issued for 10 years. But I am sure the next time when i am renewing my License, I would be applying as a US citizen hopefully and it will be for 10 years.

They are only allowed to issue the license for the same length of time as is indicated on the immigration documentation. When you say they only issued it for the length of the green card, you mean the green card as extended by the extension letter, or the green card without the letter? The green card and the letter act as 'one document' and need to be considered together. For example, If the green card expires Jan 1, 2012, then the extension letter extends its validity to January 1, 2013, and that is the date that his license should be renewed until. So, yes, bring a photocopy of the extension letter along with the original and highlight the part that states 'extended for one year and is good for work and travel" (or words to that effect). Tell them they can keep that for their records.
