Hello everyone! Advance Merry Christmas to all. I just want to ask if its alright to work on part time jobs while waiting for my EAD card? I checked the status of my case and it says initial review so i know it might take months before i can get it. Thanks!

I am just wondering what you think the point of the EAD Card is if you do not need it to work.

Part time is still a job. 3 hours a week is still a job. A job requires a work permit/EAD. Anything that is an income through working is a no-go without your EAD.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

I know what the point of EAD is but theres a diffrence between working part time and full time, and i think its pretty rude to answer a question by another question.

If you have a red stamp on the back of the I94 in your passport indicating "Employment Authorised" you can get a SSN and work. If not then don't work until you get the Employment Authorisation Card.

Thank you, :) the reason why i asked this is because a lawyer has asked me to do some documentation stuff for him and wil be working that from my house and pay is pretty good, but i was not sure if its ok to do that since i dont have my EAD yet.

When I arrived in NY I was lucky and had my I94 stamped allowing me to immediatly work for 3 months, I had my EAD before the 3 months expired. Do not work if you didn't get this stamp, if you get caught it will ruin any chance of staying in the USA.

Part time and full time jobs are different, but only in the number of hours you work. In terms of the legality, they are exactly the same. You cannot work until you have your EAD or green card, not even for an hour. If you're bored, though, you can volunteer your time.

WRONG! The OP is NOT legal to work unless they have either an EAD or a GC. That stamp was abolished as valid YEARS ago.

It is NOT okay. You would be working ILLEGALLY. You CANNOT work without an EAD or GC. The stamp is NOT valid.

You were lucky they were still permitting use of that stamp. It is not valid now. Some POE's still give it though which confuses people. Have a look at the I-9 and you will see it's not included as a valid form of work authorisation.

It used to be. The problem now is that, while you can get your SSN based off your K-1, it will say something along the lines of "not valid without work authorization" - and currently, the green card or EAD is needed to prove that work authorization. A K-1 can apply for an EAD upon arrival that would expire when the I-94 expired, but given that an EAD takes about 70-90 days to process they'd only be able to use it legally for maybe 3 weeks before they'd have to stop working.

Wow, this is misleading! At least when a K1 receives their SS card they will see the restrictions that apply. No wonder there are so many topics about this question.

OP - you cannot work for pay without GC or EAD. You may volunteer.
