RFE for I 864?

Hello, we just received a RFE wanting verification of my husband's ability to make 125% over the poverty line. However, I am confused as when he filed his tax returns showed he made at least 23000 and there are only 2 of us so that should have been okay right? They also asked for another job letter and pay stubs but we already provided these. I am confused as to why these are being requested again. Do we just send copies again. Please let me know your thoughts.

If they are asking for you to send it you need to send it. Send a load of evidence that he makes the 125%. I would also send another copy of the tax returns and W2 or the IRS transcripts again as well with the letter and pay stubs for the last while.

It could be that they want more proof or they lost some stuff etc.

If your husband is the person applying for status then you cannot use his income. Technically he is not supposed to be working unless you have already received an EAD. You will need to show as spouse supporting income without including his. If you dont meet the income requirement then you will need a joint sponsor. This was my experience also. Hopes this helps you.

Hi gigis my husband is sponsoring me so we are using his income. Also he has made at least 40000 this past year so we are going to wait for his tax returns from January and then submit the evidence they asked for. I have an EAD and also work but we are not adding my income as his should be sufficient. Good bumping into a fellow Trini!

I would schedule an Info Pass appointment to see exactly what is going on. Maybe something was lost or inadequate. You don't want to guess at what is going on or what they will accept because if you guess wrong and they aren't satisfied, your application will be denied - you won't get another RFE.

Typically it is current and ongoing income that is used, not past year's tax returns (unless the sponsor is self employed).

Submit copies of several recent paystubs and a recently dated employer letter to support the current income claim.

Thanks for your input Anh Map. I thought they looked at current income also and on theI 864 he stated he made 47000, we did submit paystubs and a letter from his employers but we still got the RFE. We will send another then. Is it true that if you don't provide exactly what is needed you get denied?

What exactly did the RFE request? What exactly has already been submitted with the I-864? How old were the paystubs and employer letter? Has the sponsor been at the current job for a short amount of time?

The pay stubs were submitted were current up until November when we filed. The letter was also done the week before. My husband has been at the job since January 2011. We submitted tax returns from last 3 years (all over 125% of the poverty line) , pay stubs, letter. His pay stubs include the accumulated amounts until each pay period.

It says a lot! There are 5 pages:

Page 1: the sponsor's income on the federal tax return did not meet or exceed 125% of the poverty guideline. It asks that we submit letter of employment and lists details that we should include such as salary (our previously submitted letter contained all these specifications)

Page 2: for the household member's income to be included it must come from a lawful source ... we are not including my income, should we just in case?

Page 3: petitioner must submit federal income tax return for most recent tax year (submitted 2010s) and all supporting tax docs.

page 4: same as page 1

Page 5: submit evidence of assets or obtain a joint.sponsor and lists requirements of assets.

I summarized as best as I could. Please let me know your thoughts and how we should proceed. Also do we have to answer each page and submit all.of these or just 1? Or the ones pertaining to us? Thanks!

Don't know if that helps, but i received an RFE for the I-864 and it also listed everything you listed and then there was one line at the very bottom of the letter that they highlighted and it stated exactly what they were looking for. I didn't realize that the first time I read the letter. So make sure to read the whole letter and check the bottom.

Be careful

There is a deadline to respond and it is quite likely he will not be able to do his income tax until late January or February, be SURE you respond before the deadline and that means they need to RECEIVE it before the deadline

Why not just send updated job information, employment letter or recent check stubs?
