She did say something like that i was to support her but she wasn't looking for that from me? She been lazy all her life so i think she lieing about it all but like you say what can i do but wait and see. As for my new fiance we have know each other about 5 years as friends more or less and i talked to her before i brought my ex wife here but didn't talk to her again until my ex wife left, I never cheated on my ex wife with my fiance now or any other woman. but i filed for my divorce after my ex wife left and i tried all the things to find her and when i found out where she went. Then it was over for me with her because i know she cheated on me then. long story short it been almost a year since she left and i think i have the right to be happy. best wishes to her and the greener grass she wanted that didn't work out if you know what i mean? so she will do what she will, on the support thing and i'll let you guys know the results. thanks for all your help on this.

Got one more question if she was to leave to go home back to the Philippines would they let her back in? or would she be out of luck?

Only if she voluntarily surrended her green card or you had concrete evidence that she was only using you for a green card and thus obtained it fraudulently. She has the green card now, there is nothing you can do. She is entitled to be here and you are on the hook for the I-864. That's the process and it's spelled out in the instructions going in. Nothing else you can do but move on.

I agree with Vanessa. I think she wants the entire divorce decree so she can file to remove conditions. She can get a copy of it on her own. She should probably do that anyway since you're probably sending her photocopies, and she'll want an original certified copy for her own records. Tell her to contact the county clerk's office in the county where you were divorced to get a certified copy. There's no point in playing coy with her. You can't stop her from getting a copy of the decree, and you'll only piss her off if you're acting like you can. The best way to deal with an ex-spouse is to be businesslike. Just give her the facts.

If she gets a job or gets married again then that would probably reduce the likelihood of her collecting any means-tested public benefits, but it won't change the terms of the affidavit of support. It remains enforceable until one of the four conditions has been met:

1. She becomes a US citizen, or

2. She loses her resident status and leaves the US, or

3. She accumulates 40 quarters (10 years) of Social Security work credits, or

4. Either of you dies.

If the sponsor dies - their estate can still be held liable, if you owed support prior to dying.

Anything that happens after the sponsor dies is not your responsibility.

OK all in all is that if she trying to get support how will i know she did? If she not trying to get support then nothing will happen unless she asking for government help right? Thanks

That's exactly right and it's not her whose going after you but it's the government if she applies for means tested benefits.. Good luck!
