#1. Let's say my soon to be husband was in a relationship a couple of years ago and they applied for a visa, but then they broke up later. Will this affect our plants for the CR1?

#2.There was a year in between our relationship where we had a rough time, and we didn't talk... Will this affect us? If we have two years before and several months afterward with proof of a relationship?

Please, any help, answers, and encouragement are welcome!!!

need more info to give some potential answers. Ultimately CO is decision maker.

#2 - If you guys have been in healthy for a good amount time, and have enough evidences, then things should be fine.

I'm not sure of all the details but they applied for the K1 Visa. I know his ex sent off the paperwork, but they broke things off soon after that. My worry is that it will cause a red flag because they had tried to apply for it before. We're applying for the CR1 in February, after our wedding. Hope this helps, and thank you for helping me understand!!

Oh, should I include the evidence of a relationship from before the year we took off (weren't talking) as well?

My fiance' was in a relationship a little over two years ago and they filed for a K1 Visa. They broke up shortly afterward and we've been together ever since.

My question is, if it's been over two years since it was filed, will it cause problems for us when we file the CR1 in February of next year?

Any help is greatly appreciated. I don't want anything to come between us being together.

I see! As long as his ex didnt get in states, then that is all right. Of course, it can be a little red flag, but no need to get too much worried about that at all. Everything should be fine then.

Get alot of evidences, you can explain your case honestly, like you guys met in 2010, then didnt talk for 1 year for whatever reason, but it still indicates about the timeframe when you guy first met.

It will not cause any problem for you in regards to you filing a petition on his behalf. However your spouse to-be should be prepared to answer any questions about the prior relationship should a CO decide to ask about it.

February 11, 2011: Registered for marriage in Wuhan, officially married!!!

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

That would be my answer but I would add that since the immigrant is coming from the UK, the prior filing will likely result in much less difficulty than if they were coming from a high fraud region.

Facts are cheap...knowing how to use them is precious...

Download the I-864, instructions for it and the I-864p.

The dumbed down version is the US Citizen needs evidence of a job with enough gross earnings to meet the 125% poverty level for their household size including the immigrant.
