Hi! I have not been active on this site for over 2 years since my fiance from Philippines K1 visa was approved and we were married May 2009 in the US (Winston-Salem, NC). Our relationship has been wonderful and has only grown stronger and we now wish to bring her adopted daughter to join us.

Anyone who can help with advice as to the fastest and least expensive way to accomplish this is most appreciated! I was born North Carolina and my wife is from Surgiao City, Philippines. We listed her daughter (legally adopted in Philippines) on documents we filed during her K1 visa process giving intentions to bring later.

Visa Journey was very helpful in our past experience with the visa process for which we deeply thankful!

she adopted her daughter? hmmm this I believe is a whole different ball game , go to the US Embassy/Manila website and read about this , I dont think its easy if the little girl is adopted. I think they have some kind of residency requirement for you. Please check it out.

Did wife have legal custody { court order } or finalized adoption for two years prior to coming to the USA? did the child reside with your wife for two years prior to coming to USA?

Yes this is what I was thinking about. Read this whole adoption section on the Embassy's website. Concerning a child that has been adopted, either by you or your spouse.

How old is the child and does she have living parents?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes she was adopted when she was 6 months old and is now 11 years old. My wife received final judgment for adoption on Aug. 2004. Her daughter has been living with my wife's sister since she arrived here in NC 2009 and we have sent monthly child support. My wife and her adopted daughter lived together from 2001 until she left Philippines 2009.

as an LPR,if your wife petitions the child, she would be in category F2. at the presnt time, visas are available for F2's with a priority date of

Apr.22, 2009. a wait time of over 2 1/2 years. as a USC you could file under a step child relationship. there is no wait time, since the child would be considered an immediate relative. the process will be much quicker for you to petition the child than your wife. you'll want to be sure you include all the documentation that proves your wife has adopted the child. these are listed on the Embassy website.

the child must satisfy all primary documentary requirements for an immigrant visa, and provide the following documents to establish their legal status as a child of the petitioner:

•A certified copy of the adoption decree,

•A certified copy of the Certificate of Finality of the adoption,

•A certified copy of the child’s original birth certificate before the adoption,

•A certified copy of the child’s birth certificate amended after the adoption,

•The legal custody decree (if custody was awarded before the adoption),

•Evidence that the child resided with the adoptive parents for at least two years, during which time they exercised primary parental control,

even if you file the petition yourself, you might want to consult an immigration attorney, preferably one who deals with immigration from the Philippines, to make sure every is in order.
