Can i get visitor visa to be with my wife ?

Why was it denied? You can apply for a visitor's visa, but they're hard to come by for spouses of USCs to begin with (as there is a presumed intent to immigrate). By filing the I-130 you've already shown you wish to immigrate so it's really unlikely you'll be approved for a visa. Additionally, whatever caused your denial is something you will still have to overcome to obtain any visa.

OUR TIMELINE

I am the USC, husband is adjusting from B2.

ADJUSTMENT OF STATUS

08.06.2010 - Sent off I-485
08.25.2010 - NOA hard copies received (x4), case status available online: 765, 131, 130.
10.15.2010 - RFE received: need 2 additional photos for AP.
10.18.2010 - RFE response sent certified mail
10.21.2010 - Service request placed for biometrics
10.25.2010 - RFE received per USCIS
10.26.2010 - Text/email received - AP approved!
10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved
11.10.2010 - EAD received
12.11.2010 - Interview letter received - 01.13.11
01.13.2011 - Interview - no decision on the spot
01.24.2011 - Approved! Card production ordered!

REMOVAL OF CONDITIONS

11.02.2012 - Mailed I-751 packet to VSC
11.08.2012 - Checks cashed
11.10.2012 - NOA1 received, dated 11.06.2012
11.17.2012 - Biometrics letter received for 12.05.2012
11.23.2012 - Successful early biometrics walk-in

05.03.2013 - Approved! Card production ordered!

I'm sorry but I doubt they'll give you one because they'd think if you got the tourist visa you wouldn't return.

You can't enter the USA on a tourist visa with the intention of staying and living there and as you've had a denied I-130 and you have a wife in the USA they will conclude that you will not return.

Thats just my thoughts on the situation, I'm not saying don't try I'm just pointing out what the most probably outcome will be.

Highly unlikely. You have already requested immigration to America, so they know you want to live there. You have also been denied an I-130, so they feel your motives are dubious. It would be almost impossible for you to prove that you will not overstay your visitors visa.

I would suggest that you get your wife a family visa to Saudi Arabia instead, or meet in a third nation.

it was not approved bc we didnt record our chat ,most of our talks was on yahoo > we are appealing now . i dont know wat to do ?

Well you cannot just tell CO "my wife doesn't dare to come to this country so have to go to the US." With this reason, it is enough for CO to doubt your marriage is in good faith already. Once you showed your intention to immigrate (and it was denied), there would be no chance for you to obtain a non-immigrant visa. About your appeal, if you cannot have more persuasive proofs other than chat logs (which you don't have), it wouldn't make anything better then first initial decision.

I assume they didn't approve it, then, because they felt you didn't have enough evidence of a bondafide relationship. Unfortunately, that's going to be hard to gather unless you guys visit each other. You're already married, so where did you meet before? If she isn't comfortable coming to you, I'd suggest you guys spend some more time together in a third country. It's going to be difficult to appeal if your wife isn't making an effort to visit you and you have little evidence of a relationship, and harder still to get a tourist visa, unfortunately.

Meet in Egypt! Or Dubai! :) Visit any of those places with your wife and have a blast. Then collect as much evidence as possible, like photos and boarding passes. All the best!

December 2009 -- Visit to Malaysia.

February 2010 -- Applied for B2 visa, approved.

March 2010 -- Visited US.

April 2010 -- Returned from US.

May 2010 -- Sent in K1 Visa application.

July 2010 -- Received NOA2 in 71 days from NOA1.

July 2010 -- Packet 3 received.

August 2010 -- Cancellation of K1 Visa application.

Totally agree. Dubai is very easy for you to get to and as a USC she gets her visa stamped at the airport. Very tourist friendly for Americans. If she is nervous about it she can PM me and I can help to put her mind at ease.

if you are native saudi, i find it odd that you not simply get a tourist visa and go.

i wanted to tell that im egyptian and living in saudi arabia , we got married in egypt , now i cant live in egypt because my work is in saudi , also my wife cant come to saudi

we will take vacation and go to turky or dubi
