f1 visa will go out of status

I have valid f1 visa from last 4 years. I started with master. Admitted to phd program (different university). And now not able to continue phd program.

Actually they are going to kick me out from the program. Also I didnt applied for opt nor other university for different eduvation program.

Also I am valid for this semester, which is going to end in next week. Actaully i did bad in the grades and exam so it means I am not going to continue the graduate program after this semester,

My questions is 1)what are my options?

2)How many days i can legally get to stay here? I mean after the semester ends which is the last legal day for me in usa?

3)how many extra days i can stay here?

4)If i stay here 10-15 days extra here is that going to be an issue? Atleast i will grab what i wanted and will leave the county with pride.

5) what is there actions (immigration office)? if i stay little more days extra here. I dont want to get humiliated with deporting thing or forceful sending back. I still have my pride and will like to go back happily? Is that they give u warning before deporting or not?

6) How do i find the last day of my valid visa stay here?

I am confused, so have you finished master degree? If yes, you can apply for OPT right now because you have 2 months grace period after your graduation.

If you just drop out school for next semester, it is most likely your school will report your when you are not enrolling so you are still in status now. Forceful removal takes a while after you are reported by school that you drop out. And you have 30 days to wrap you thing up before removal takes place. You need to talk to your International Counselor though. Good luck.

PS: Your authorized period of stay is your I-20 course finish day (no expiration on I-94)

Thanks for your response.

I finished master 2 years back(in 2008) then I admitted to Phd program right after ( without applying opt, it means i will not able to get optfor my master) to get an opt i have to graduate with phd or any other master.

Now (from 2008) i admitted to phd program, and due to my progress issues i can not able to continue, they will force me to leave the phd program. Also they wont alow me to get second master degree also.

I talked to my international advisor abt this, he is not sure about number of days to stay or find another option.

Also I am convincing my dept chair to keep me in phd program for one more semester so I can sort out things ..

Well then I believe you got 30 days to leave after your school report your to DHS about your drop-out. Because you have a master degree, you can find a company, which can sponsor your H1B working visa while you are still in the US. But you wait until now to find, it would be late. Because your status will be out once school report. Best solution now is to convince the school chair to give you another shot for another semester. Then you can have more time to find a sponsorship for a H1B visa. Google "Visa Sponsorship through company" Good luck.

yes I am trying to convince my dept chair for this. He is not agreed yet but I think ( i wish ) he will find some way to stay me here for on more sem.

I explained all the situation to him, also asked my international advisor to convince him. I hope he will agree.

Only in this week (monday) i came to know that they are forcing me to push out of the program.

Thanks for your all valuable suggestions.

What do think about it consultant's? is they can sponsor in 30 days period?

30 days to leave is always given when DHS starts the removal process, you don't need to ask for.

Ask if they will accept academic probation at your school but be aware that they will want to see major progress in your work and your grades. If they will not grant a probation period you have 30 days after the semester ends to return to your home-country.

check in with yer DSO at yer school, ask them what yer options are.

If they won't have you anymore, then I suggest you start packing. Don't abuse this priviledge by staying in the USA for the spring semester.

hi, Thanks for your suggestions.

Here is update...

One of friend advise me to look for ESL course (english as second language). I checked with my esl dept in my university, and they are agree to offer me english course. (fees is though $2000 for 7-8 weeks). So I will apply on monday (they told me it will take a day to admit you).

Also waiting for my dept chair decision (yet he has to make). If he allows me to transfer to master then I will graduate with master rather than ESL cousess.

Also esl course atleast give me buffer period till next fall, so I can make my decision to apply to other university or look for h1-b job.

Please give me your valuable suggestions.

If you are able to transfer to either the MA program or the ESL program, you can stay under the F1 visa you currently have. You will have to get a new I-20 though to reflect these changes in your studies, and you may be required to show new proof of adequate finances to pay for the studies and living expenses.

When ever it is that you decide to either stop studying or you graduate, as mentioned before, you will have 30 days to leave the US to avoid falling out of status. If OPT is an option for you, or you find an employer who is willing to sponsor you a visa, you can obviously stay here either as F1 on OPT or with an H1-B visa.

Just keep in mind while you are changing the course of your studies that no matter what you are studying, you will have to be a full time student and take a full time course load to meet the F1 visa requirements.

H1-B's, thankfully, are getting harder to get , using the 'flip from F1/OPT' trick.

USCIS is cutting them off this quarter and next - should be down to 0 by 3rd quarter of 2012.
