Is there any particular reason you feel you might need a lawyer present at the interview?

Being nervous is normal, I think everyone is nervous before the interview no matter how solid or simple their case seems to be. I know I was. Your evidence seems to be pretty thorough, I doubt you would need more. Except for the original marriage certificate of course. Just have all your documents in good order so you can easily find whatever the IO may ask for, remember to bring all originals of copies you submitted, and if you have an SSN number bring the card - they often ask for that.

Have you been an F1 the whole 8 years you were here, or did you fall out of status at some point? Overstay and unauthorized work will be overlooked as you are adjusting based on marriage to a USC, as long as you did not use anyone elses SSN or present yourself as a US citizen at any point during the years you've been here.

Agree with Little_My. In terms of documents, the ones you have look good. The only other thing I recall being asked for by our IO was if we had copies of our receipts for our rings.

the reason i am being nervous because i have been out of status for a while now and have also been working illegally .. the reason i asked about the lawyer because i heard stories that some times IO ask lawyers to sit in the lobby while interviewing husband and wife if that happens with ujs then why take a lawyer .... i cant pay him 1500 just to sit in the lobby .

Posted

Working illegally is overlooked for spouses of USCs as long as there arent other issues like claiming to be a USC to work. You probably don't need your lawyer there because honestly, he can't change the facts anyway.

sounds like you dont need a lawyer. We did it on our own and we had more issues than you do. Just relax and be yourselves. its more of a conversation than an interrogation.

the reason i am being nervous because i have been out of status for a while now and have also been working illegally ..

Working without authorization is not being made an issue of at the AoS stage or thereafter.

What matters is that you did not claim to be a U.S. citizen (i.e., on the I-9 form), did not provide false documents, did not use somebody else's SSN, and that you did file your income tax return.

Again, the I.O. knows that you worked, so I would just add my income tax return to the package, which would pretty much eliminate any question from him or her if you filed. Not filing taxes is tax evasion, and while it's not directly an immigration issue, it's closely related.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . The one absolutely certain way of bringing this nation to ruin, of preventing all possibility of its continuing to be a nation at all, would be to permit it to become a tangle of squabbling nationalities, an intricate knot of German-Americans, Irish-Americans, English-Americans, French-Americans, Scandinavian-Americans or Italian-Americans, each preserving its separate nationality, each at heart feeling more sympathy with Europeans of that nationality, than with the other citizens of the American Republic . . . . There is no such thing as a hyphenated American who is a good American. The only man who is a good American is the man who is an American and nothing else.

im sure you can recover the data. open the laptop and let it dry out(take the battery out, take all the screws out and open the cover and remove any components that are attached to it. Let it air dry overnight. Use some alcohol on a Q-tip to remove any sticky residue. If all else fails you can bring it to a shop and they can pop out the hard drive and recover the data.

my wife did the same with her laptop and thats what I did. it wouldn't turn on and she thought it was toast. Took it all apart, let it dry, reassembled it and it fired right up.

Just take your wedding album. I took my wedding album plus some extra printed pics, but the IO just wanted to look at the wedding album and didn't want any of the extra pics for the file.

i disagree and say bring everything. Our IO didnt even look at our wedding album and only looked thorough our personal photo album. our theory was bring as much proof as we possibly could. when the IO asked for something, we kept handing paper upon paper until she said stop.
