Visiting US using B1/B2 Visa

Hello VJ friends,

I am an US citizen married a foreign citizen in Aug 2011. I have filed for both I-130 and I-129F in Sep 2011. My spouse has a visiting visa valid (B1 or B2) for 10 years. Can he visit the US temporarily using that visa while the immigrant visa is in process? Please let me know.

I was planning to visit him for Christmas but my employer denied my leave request.

A valid tourist visa only permits someone to apply for admittance, it does not guarentee entrance into the US

September 10, 2013 Interview - decision could not be made.

April 15, 2014 APPROVED. Wait for oath ceremony

Waited...

September 29, 2015 - sent letter to senator.

October 16, 2015 - US Citizen

He can definitely try, but there are no guarantees that he will be allowed entry at the POE.

December 2009 -- Visit to Malaysia.

February 2010 -- Applied for B2 visa, approved.

March 2010 -- Visited US.

April 2010 -- Returned from US.

May 2010 -- Sent in K1 Visa application.

July 2010 -- Received NOA2 in 71 days from NOA1.

July 2010 -- Packet 3 received.

August 2010 -- Cancellation of K1 Visa application.
