I think they use standard form for everyone. I don't have my letter handy but I think I saw that in my letter.

I think they use standard form for everyone. I don't have my letter handy but I think I saw that in my letter.

That's the problem with the forum. Many of us forget that we are just a small segment of the hundred thousands that are adjusting status. Yes everyone has an interview (at embassy) but i dont believe all are called for intreview upon AOS. Moreover I believe the timeline here is only 19%, so keep that in mind.

I had provided that paperwork prior to POE (during k1 approval). They have to prove custody in order to process application for your child/ren ( mine is k2). I'm confused why they are requiring evidence of that from the USC though. Just make sure you have it. Always produce what they request on their notification.

isn't it only those who adjust from K-1? they not always have an interview..

I'm confused why they are requiring evidence of that from the USC though. Just make sure you have it. Always produce what they request on their notification.

but the problem is that we don't have it.. and will not get it by the time of interview. my husband and his ex were never married and never went to court for the custody. child lives with us right now, because mother basically abandoned him and the kid just doesn't want to be with her anymore. we're trying to get full custody of him but it's soooo hard :wacko: so if IO will want to see (for any reason) custody papers.. they don't exist..

but what confuses me the most is that it says to bring custody papers of children NOT living with you.. he does live..

ugh, i guess we'll just have to explain if it comes up at the interview..

I have no children and no experience with these issues, but it seems to me by the language of the instructions that they are not asking for custody papers of your spouse's child since he DOES live with you? In other words, I don't think that line of instruction applies to your situation. (Again, I'm just basing it on the language and not on any personal experience or knowledge about the topic.)

Yes, everyone that AOS from work, student and tourist visa will have the interviews.

For the custody papers, my husband (USC) has the divorce decree that states who has the custody of his children. So I think the divorce decree would work though since it was signed by the judge. Anyway, I'm waiting to get an interview, so I cannot confirm if it is enough.

You might be held up until you obtain your custody documents. My I12F requested this document for my son (k2). If they don't have that how will you be able to AOS the child? Suppose you didn't have full custody (they would be up s#$t creek in a kidnapping case). Contact the courts and get the custody docs mailed to you. Or if it's stipulated on your divorce decree, you can use that. As for the USC he can explain that to them. His child is not being taken out of the country so it shouldn't matter much.

You might be held up until you obtain your custody documents. My I12F requested this document for my son (k2). If they don't have that how will you be able to AOS the child? Suppose you didn't have full custody (they would be up s#$t creek in a kidnapping case). Contact the courts and get the custody docs mailed to you. Oh that makes it simple then... all your husband will do is explain the situation and prove that he provides full care for the child and that the child also resides with him. The USC will have to just provide evidence for his story (taxes showing child is a dependent, school letter from the principal). I don't think this will be a big deal for the USC.
