What Do You Do If You Are Denied a Visa?

Moving to Quebec would be really difficult as I'm not bilingual and that would make it very difficult for me to find meaningful and financially sufficient work. We like Vancouver, as it's temperate, but Toronto would be a lot closer to his mom...

I'm not adverse to moving to Canada. It would just be very difficult to sell the house here and find a place there that would be good for our three dogs.

At this point, I'm a lot more welcome in Canada than he is here :(

Last time I was there, I saw commercials on TV advertising how to legally immigrate...can you imagine how attitudes and laws would have to change in the US to get to a point where we're advertising immigration? I wish...

Canada is the second largest country and has only 38 million people...we have over 300...of course they want people to go there.

Yeah there are a lot of great places in the world but let's be honest...no where is comparable to the States. This is the land of opportunity...the land of milk and honey and as much as I love visiting other places and cultures I would NEVER live anywhere else.

I think you'll find that there are ALOT of places that are much better!

If you are denied your K1 visa and submit a waiver and are still denied what have you done about it? There are certain things that make a person inadmissible to the US that never change. What will you do if you fall into that category?

I came very close to having to live out this reality. My husband was permanently inadmissible due to misrepresentation. It was a terrifying time in our lives that still haunts me to this very day. Our son, who was 3 at the time my husband left the US, has a congenital heart defect which cannot be easily or adequately treated in Algeria. A few months after his departure, our son was in the hospital again. I COULD NOT leave the US with him in that condition. So I stayed in the US living, working, and taking care of our son alone while we waited for him to return. We managed to visit him one time at about the halfway point of our 27 month separation, but it helped to keep us going.

Our plans, if the waivers weren't approved were as follows: 1) move to Algeria with him utilizing his technical degree and working in the oil and gas sector or 2) move to Canada or the UAE on skilled worker visas based on my allied health degree. I am thankful that we had those options because you cannot maintain a long distance relationship for an extended period of time without a plan to reunite. I am even more thankful that we didn't have to do either of those things.

Personally, I know two people who had waivers denied that were approved on appeal. The appeal itself took 29 months but in the end their families were reunited. Then, there are others who simply refile the waivers(one filed 3 times before moving to Albania) with some being approved and some being denied. It can really go either way. My suggestion is to investigate the subject fully and hire a good lawyer to prepare a top-notch waiver packet.

What do yo do if you don't have the option to move? I have four children joint custody with their dad so it would not be an option for me to take my children with me.

thats what ive been wondering too. i am the intending immigrant but Jenni has 2 young children (4&6) and there is no way that their father would allow them to leave the US, so for me... the only option is to hope and pray that my visa is approved... otherwise it is game over.

What could go wrong? Have you ever tried to overthrow a government? Damned UN peace keeping forces could screw up the whole thing. The US could try to restore my government and run it as a puppet regime. Not to mention all my loyal citizens.

One may want to rethink the whole "land of opportunity" concept when concerning the United States and the world as a whole. I grew up in Canada and recently moved to the United States back in August of 2011. We're in the middle of a massive recession, unemployment is at 8.6 percent, and this country is $15 trillion dollars in debt. I love the United States immensely, am happy to be here, but I am also a realist. To be quite honest, there are several other countries that are in much better shape at this current moment in time, including the one I recently left.

Do not use that cliche term, especially not right now.

First of all, I agree that it's a cliche term and shouldn't really be used, especially in the current situation.

However, as far as opportunity goes, the situation is understandably not very simple. While many countries are currently in (much) better shape than the US, a lot of the opportunities are restricted to long established citizens of the country.

For example, in Germany, your future path is decided early on, what gymnasium (grammar school) you go, which secondary school you go, which path (apprenticeship,etc) you take. It's not practical for a foreigner to go in and decide to be a surgeon in their 20s for example. Similar strict structure in Japan.

On the other hand, I have many many coworkers that came here from Vietnam (after the war) in their 20s and 30s. They completed engineering degrees and now hold positions that pay on average over $150k. I could never do that by going to Japan. My choices are either to teach English there or get hired by a US company.

And in Japan there is less variation in pay between professions. There is honor in having an important job but the pay is secondary. Certainly no $100k+ jobs for recent (~10 year) immigrants.

Unfortunately with this "the sky is the limit" mentality here, the downside is that for every $150k job there are numerous that are much lower in pay.
