In the situation that the OP describes, the legal presence that a university will likely want to see is likely the green card as the fiancee/spouse did not enter with a student visa.

As I said, it was not my experience. Not to say some university wouldn't say that, I just did not run into it here in the many I spoke to. We used Alla's I-94 and passport. She started her classes even before we got married. Less than a week after stepping off the plane.

I DID run into several that did not require even proof that she was legally in the country. When I asked I was specifically told no such proof was needed.

ASAP, actually she probably only needs the SSN and not to be married.

Alla needed her SSN but ONLY because she was being given a 50% grant/scholarship which must be reported to the IRS. If she were just going to enroll and pay cash she wouldn't even need the SSN, at least not as far as I could tell. At any rate, she got her SSN two days after arriving which any K-1 can do.

I NEVER said that education is restricted. I was talking about the FEES. I am not so far out of college, and did plenty of research in going out of state for my education. I had looked into 7 different out of state colleges from my residence. YES they were public universities. YES all of them required 1 year of out of state residence fees.

I'm trying to find out where in my post I implied that a K-1 visa holder is restricted from enrolling in a school? Please show me where in that one sentence I said any of that.

And my post was in reply to another post, as I quoted it. Not a reply to the OP. Kind of like how you replied to my reply.

Did I say you said that? Why are you arguing or taking offense to something clearly not offensive?

as I have said several times and as has been reported here by others, there ARE NO concrete rules regarding in state tuition that plly across the board. Period. Each state and college has individual rules.

Even more confusing is that some states like my state (Maryland) have exemptions to this rule. If are married and your spouse has lived in MD for over a year then you can get in-state tuition rates immediately. You just need to prove your marriage and send in a couple of your spouses utility bills.

Does that include individuals who are not citizens?

If so that's good to know for people in that state. Then they would only need to wait until they're married. But some states/schools don't let this apply to green card holders.

Nor did I state that there are concrete rules. I said "many." Which is the case.

More than half of your reply to my reply was not in regard to the topic I was on.

THE UTA INTERNATIONAL STUDENTS ADVISORY

My wife began her Master's program 5 days after her arrival and 3 days BEFORE we got married.

The K-1 does not restrict education in any way. She is free to attaend ANY school or university. The school will probably ask for proof of "legal presence" and some states have restrictions on her being classified as a "resident" for the purpose of reduced tuition, others waive the restriction if she shows she moved here for other than education purposes.

Alla started a Master's program 5 days after arrival with a 50% private scholarship. Everything was arranged before she arrived, she only had to show up, show proof of legal presence and give a SSN. She applied for her SSN 16 hours after her arrival and had the number the next day.

Our son, a K-2, began 8th grade the second day after arrival

We have everything set to enroll my wife in a Graduate program the Fall of 2012. Texas' residential status is 6 Months.

:bonk:

Someone was already saying that. MANY states waive the one year requirement IF the person moved there for "other than educational purposes", ie., marriage, job relocation, military assignment, yada, yada.

These are things the OP needs to check for each individual school they are interested in.

How long after i marry my fiance can she attend a University here in the USA?

In the State of Florida, as long as you have lived in the State for a year or more, your new fiancee could attend the university without paying out of state fees. Her instate residency can be proved by you. She would just need to be a registered voter, and have a DL. Then they would use your info to satisfy her residency . I would check your state and ask about these other possibilities. They are not usually listed up front because they don't want it to be abused.

She cannot register to vote until she is a citizen. NO ONE in any state is required to be registered to vote or have a DL to be considered a resident for tuition purposes. No doubt those things COULDbe used to establish residency, they would not be the only way to satisfy the requirement.

The OP asked when his fiancee could enroll in school. The answer is "immediately". These other considerations regard being considered a state "resident" for tuition and have nothing to do with whether a person can attend school or not, it only affects what they PAY to attend school and only applies to state subsidized schools.
