I have 2 yrs green card based on marriage. I met her online when I was doing my masters degree program in Europe, later she came to Europe to see me which she spent two weeks with me. After she went back to the States, she said that she would like us to get married and live together. She also said that I have to transfer and complete my masters program in the United States, to be honest I agreed with her decision then.

She filed for me to come over which I was granted the K1 Visa. We got married after one month I arrived in the State. All her family members welcomed me and accepted me. She took me to some Universities for admission in order to complete my studies here. After we went through all the Immigration procedures, I was granted 2 yrs visa, then I started applying for jobs while waiting for my social security number. To my surprise, I came back one day from job interview she told me that her ex-husband wants to come back to her, that he knows about me and he does not want me to benefit from everything he left for her or be around his daughter. After some arguments between her and I, she asked me to go back to my country or back to Europe. That she does not want to lose her daughter to her ex-husband.

Initially, I thought she was joking until when my social security card arrived which I was supposed to use for job she collected it and refused to give it to me. She said that I do not need it, and I do not need to work here in the States. After everything she refused to give me my SSN. She asked to leave her house which I did.

She filed divorce within 5 months we got married. I called her recently she told me that she is dating another man and I should stop calling her.

My 2 yrs green card is conditional which will expire January 2013. I do not have any documents to prove for the marriage except my marriage certificate and some pictures because she refused to open a joint account with me and refused to include me in her health insurance.

Please I want advise on what to do based on my situation? Is there any hope for me to win this battle.

If you were in abusive relationship, and want to remove condition, then you would have to apply for " Waiver Application ".

Regarding SSN, you may apply for re-issue at your new address.

She can't withhold your SS card and opening your mail is a federal office , you should have turned her in to the postal inspector. You need to gather whatever evidence you have that the relationship was real to use for ROC

This will not be over quickly. You will not enjoy this.

She cannot open your mail nor can she withhold your SSN card that’s illegal.

It seems now you want to live in US and don’t want to go back to Europe, as your earlier statement. If you want to return to Europe then you don’t have to do anything.

Your timeline looks strange to me.

You came on K-1 and married after 1 month.

Let's say you filed for AOS immediately after marriage. 4 months later you are divorced.

Getting divorced takes some time, I give it a minimum of 2 weeks. In reality, it should be at least a month - to prepare the documents, may be to find a lawyer and to go through motions in court.

So this means that your AOS was approved in 3 months and without joint evidence? C'mon.

Anyhow, you can file I-751 with a waiver. But you do need to have some evidence of "bona fides" of your relationship. VAWA will not help you, it will only complicate your case, because then you will have to prove both abuse and bona fides.

June'07 NOA2 per USCIS website!

Waiver I-751 timeline

July'09 Check cashed.

Jan'10 10 year GC received.

Sometimes marriages just don't work out. In fact, about half of all marriages in the U.S. end in divorce. Sad, but true.

You were required to file for Removal of Conditions once your divorce was final. In fact, the divorce kind of "voided" your residency as the condition under which you obtained residency, marriage to a U.S. citizen, doesn't exist anymore. Had your ex-wife informed the USCIS that you are divorced, they would have already seeked to remove you from the United States.

Since you have no proof of a viable marriage, as you stated, I suggest you plan on moving back to the United Kingdom on your own terms.
