How could I begin the petition for my son if a passport is required, which I'll only have with his legally changed name when the adoption is complete?

The passport isn't needed until after the petition is approved. If it is approved before the passport is ready, they'll wait.

March 2010 -- Visited US.

April 2010 -- Returned from US.

May 2010 -- Sent in K1 Visa application.

July 2010 -- Received NOA2 in 71 days from NOA1.

July 2010 -- Packet 3 received.

August 2010 -- Cancellation of K1 Visa application.

I was taking a look at the I-130 form and I realized that for my son's visa I'll be listing his current last name, but once the adoption is finalized his last name will be changed to mine. Does that make any difference in getting a head start and filing the I-130 now?

Could you elaborate on that? On the I-130, it asks if the petitioner and beneficiary are related by adoption. If I file now, the answer would be no and in two months time it would be yes. I'll be filing for one name now and continuing the process for a different name. I'd love to get started on things now, but I don't want to risk complicating anything.

Add a note that the adoption is in process. You can just hand print it near the question when you answer "no".

Hi everybody,

One last question on my situation. Will the application for my wife's visa and adopted son's visa take the same amount of time to process? If I file both at the same time, would they both likely be processed in the same amount of time? Or is there any reason to think that one application could take longer than the other?

These are petitions, not applications for anything. If you file them together, with rare exception, they will be processed together. Once the I-130 petitions are approved, they will apply for visas.
