No InfoPass appts available for temp EAD

We're 14 days out from our 91th day so I thought I'd see what infopass appts are available. When I try the infopass scheduler at uscis.gov I get this:

"At this time, there are no information appointments available for the office in your area. Please try back again later."

It only does this if I choose "It's been more than 90 days since you filed an EAD blah blah blah".

What a F'ed up system. Can't see our EAD and AP applications online. Got RFEd on the I-485 for something I included in the orginal. Might not even be able to get a temp EAD cause of that, and now I can't even TRY!

UUUUUGGGGGGHHHHHHHHHHHHHHHHHHHHH! Banging head against keyboard.

Ok, I feel better... anyone ever see the above error?

Oh that is terrible... I heard that rumor (I am not sure) that they don't issue EADs any longer in district offices... Maybe that is why there is no appointment available? I hope it's not true though!

Beginning October 1, 2006, a Form I-765 received at any local office will be returned to the applicant advising the individual that the form needs to be filed directly with either a Service Center or the Chicago Lockbox.

Failure to complete the adjudication within this time frame requires the Service to grant an employment authorization document for a period not to exceed 240 days. Try to make an Infopass Appointment and print it out and bring it when u visit the office for your Infopass. In my case i make an Infopass yesterday eventhough im still 24 days in advance for my 90 days processing of EAD. When i talked to the Officer, he told me that it shows my EAD approved Sept. 20 and it should be in mail anyday, i just hope the mailman won't failed me :lol:

Noted: I read that memo, at the Office front counter in Atlanta, but at the end of the note they put a reference email address for you to used for follow-up your EAD card. So if and when my EAD card didnt arrived in our house thats my last hope, bugging them thru email since they don't give interim EAD anymore.

This is about the orginal form I-765. I want to get a temp EAD based on the fact they haven't processed our EAD within 90 days. You don't have to file a form I-765 to get a temp EAD, all you have to do is show your I-765 NOA1 that's 91 plus days old. They are changing the rules to make all EADs go to the drop box in the hope they can elimnate Temp EADs at the offices, but that will only happen if the process all EADs within 90 days.

Local offices will still have to issue temp EADs after 91 days, but without being able to get an infopass appt I can't get a temp EAD based upon the 90 day rule. ERRRR!

They are still required to give out temp EAD if the orginal EAD isn't done within 90 days. The memo change only affects them taking the orginal I-765.

Bly - where did you get that information? We did make an Infopass Appt. for my husband's EAD after the 90 days since filing had expired. We were told local offices were no longer issueing the EAD's and we would have to wait until a decision was made. I have contacted my senator and they are doing an inquiry so I'll keep everyone posted if I find out anything.

So, the NBC is responsible for issuing one form of EAD either interim or normal EAD.

I just wanted to clarify that you do fill out a new I-765 right at the DO when requesting an interim EAD. So the policies quoted seem to apply to interims.

I did not fill out anything at the DO but the officer did everthing she was supposed to do. She called the NBC. However they use voicemail and call back. At the time I was there, it was too early for them to call back. 2 hours later still nobody had called back. I just went home then. I don't know what they said, what was up with the case, but 9 days later it was approved. I don't know if it was coincidence or because I had that appointment and they finally worked on my case?

I should have been a little more clear, local offices are still required to process an interim EAD, they don't issue it. Your local field office is still required to deal with your interim EAD, it is the law. They should have called the service center and had your EAD approved or an interim issued to you. Pay attention to: "Upon receipt of Form I-765 requesting an interim EAD, local field offices are required to perform the following tasks."

You are right, I miss spoke. You do have to fill out another I-765 but the DO is required to take it and follow the steps listed. She was turned away and told they can't do anything, which isn't the case. My quesiton is how to I get an infopass appt to have them follow the steps they are required to take.

Even before these policy changes, occasionally people would have trouble making infopass appointments. It was usually easily resolved by just trying again the next day. I hope you have better luck soon!

This is my first post on VJ :yes:

Anyway, I just wanted to add my own EAD saga as it is still fresh. I applied for my renewal EAD on June 14th. My ND is June 15th.

I did my biometrics on July 15th. I have been waiting since. I called the cust serv number and the lady made a note and gave me a referral number. I made an infopass at the Minneapolis, MN office yesterday and drove the 1.5 hours to find out what was going on, and to get an interim since it has been about 100 days.

The lady at the counter told me that everything looked good and she doesnt know why I haven't it yet but that she will send an email to NBC??! She also informed me that they are no longer issueing interims as of Sept 1.

She said I just had to wait - but I can be assured she has sent an email. I left there very angry and afraid for the worse - my employers can't be asked to wait - they'll give me the boot if it is not renewed in good time :help:

Anyway, the I got home and I had a letter from the same local office saying that my EAD was approved and I had to make an infopass appointment online to come pick it up at the same office I jsut got back from. :crying:

Is this the darndest thing you ever heard or what? Why didn't they mail it to me instead of mailing me a notice that it was approved and with them? And why didn't she know that?

Anyway, in addition to the above posts, yes, interim EADs are no more. And yes, we are all doomed with this new process as there is (seemingly) no recourse for if they don't process it efficiently (within 90days)

They probably only book infopasses so many days/weeks in advance. That is what they do for appointments at the ASCs. I would just keep trying every day first thing in the morning so that as each new day of appointments becomes available you are able to get one of the newly available appointments. Good luck.

Even though DO's do not appear to provide us with that service of issuing the interim EAD's anymore, infopass should still be available if you do need to ask questions about the status. Try making the appointment ever so often (people do cancel ;) ) throughout the day.

Brad, were any RFE's issued in connection with your pending EAD application? The answer to this question has nothing to do with your ability to schedule an infopass appointment but has a lot to do with your eligibility for an interim EAD (depending on the type, RFE either suspend or restart the running of the 90 day period).

To give you some background, under 8 CFR 274a.13(d) USCIS has 90 days from the date of their receipt of the application to issue you an employment authorization (there are a few categories of immigrants to whom the 90 day rule does not apply). USCIS' failure to comply with the 90 day requirement results in the automatic grant of an employment authorization for a period not to exceed 240 days.

Now, in the event that your employment authorization application is missing required INITIAL evidence, under 8 CFR 102.2 ( B )(10) the 90-day countdown does not start until USCIS receives that evidence.

Now, if your application is missing anything OTHER than the required initial evidence or if USCIS requests ADDITIONAL evidence, then the countdown clock is simply suspended until USCIS receives such evidence.

To illustrate, if your employment authorization petition has been with USCIS for 20 days, then USCIS requests additional evidence of your eligibility, USCIS will have 70 days to finish processing the application after USCIS receives the evidence. Now, under the same scenario, if the required INITIAL evidence was missing, USCIS would have the full 90 days after you submit such initial evidence to finish processing your application.
