hi everyone,

I just need some advice - I am permanent resident been here 11 years from the UK and I am currently applying for my citizenship. I hopefully should have this in a few months when I do I was going to file a I130 for my sister/her family who lives in the UK to move to the USA. My question is....

1) My sister has a fiance and a baby due in January 2012 - can I file while she is still single or should I wait until she is married which will probably happen next year?

2) How long does it take for this process is it several years or more?

3) Then when she is granted, how do I then petition for her husband and child? Or can she do that?

4) Her fiance is an engineer and in high demand over here - can he apply for a work visa and come over with his family if granted while my sister is waiting for her I130?

You should file for her as soon as you can, the wait is over 10 years currently. you can file for her as single and then later on update her status, unless she marries before you are a USC. Her spouse and children under 21 will come with her as derivatives.

He can apply for a work visa if he can find a company that will sponsor him. They can stay here but they must never be out of status in the country to adjust here.

He can apply for a work visa if he can find a company that will sponsor him. They can stay here but they must never be out of status in the country to adjust here.

You should file for them NOW . It does NOT matter if she is single or married since you are siblings. if she and her fiance get married then he immigrates with her under your petition, if not she will file for whoever is her spouse/fiance after she comes. as long as her kids are under 21years, they automatically become eligible under your petition for her. Just make sure their names are included in her I-130 and update immigration of any new addition to the family in subsequent years

01/08/2013: Case # and IIN assigned ( file arrived NVC mail room 12/20/12)
01/09/2013: AOS invoiced and paid, DS-3032 emailed and mailed.
01/16/2013: IV invoiced &paid. AOS & IV mailed in one package(arrived 01/18).

01/28/2013: Case complete!!!
04/19/2013: Interview; APPROVED!!!!!
05/13/2013: POE; JFK


N-400: (3 months and 12 days)

IR-5 for Mom Entire process took 5 months exactly

NOA 1: 2011-10-03 (text & email)
NOA 2: 2011-10-25 (text and email)
NVC: (19 days)
Case entered and # assigned: 2011-11-18
NVC Case COMPLETED: 2011-12-07 ( 43 days from NOA 2 and 65 days from NOA 1)
Interview Date(Lagos): 2012-01- 23
Mom was late for interview
New Interview date: 2012-02-29 : VISA APPROVED

They are included as derivatives, husband if still married, child if under 21.

He can not, a prospective employer could.

he is asking the question on the premise that ONCE het gets his citizenship , can he file for sibling which is why the issue of being an LPR for 11years but now on naturalization patha was mentioned. Telling him to file NOW means the moment he gets the citizenship( since he already mentioned "when I do"), he shd be dropping the documents for sibling in the nearest post office.
