Has anyone had difficulties enrolling for school or applying for their drivers permit?

For the school/drive permit is it really necessary to wait until AOS is received and after to be able to enroll?(i did check at one school and they said i need AOS)

We are in the state of Florida and realize it differs from state to state........but we have seen very little on here about chief concerns about getting driving license as well as enrolling in school (we are not looking to enroll in a degree program but rather just english as a second language program run by most community colleges and since they are primarily federally funded we have been advised complete AOS is needed in lieu of a student visa)

The primary reason for this question is because even though I have just arrived in country I really dont want to have to wait for AOS to be complete to start these things if possible. Would love to hear your stories or thoughts or any guidance you may provide :)

Thank you!

In our area the ESL classes are free and offered as adult continuing education at the high school. No need to have a green card.

We were able to get my wife's drivers license with the NOA for her green card, but I have heard others needed the actual green card.

You should check your local DMV website. It really depends on the state. I'm in Texas and all they wanted was my EAD card and Social Security Card. Some states(like Washington state) don't even need EAD card or some states(I heard Florida?) won't even let you make license with EAD card.

This stuff is up in the air right now. Congress passed the RealID act in 2005. One of the requirements of the act was that states would have to verify immigration status before issuing a drivers license or state ID card. The intention was to circumvent criticism that the United States had no national ID card, and provide uniform requirements that every state issued ID had to meet in order to be recognized as valid identification by the federal government and other states. About half of the states have either complied or made progress in complying with the law. The other half have either passed legislation or have legislation pending that would establish their refusal to comply with the law. The current President's administration is opposed to the law and wants it repealed. The head of DHS, Janet Napolitano, is an outspoken critic of the law.

The state of Florida has two bills on the 2012 calendar, house bill HB-109 and senate bill S-220, that would end compliance with several of the ReadID act requirements.

Anyway, even if the RealID act is repealed it won't change the situation in some states. California, for example, has already largely complied with the federal law, and has a separate state law that requires proof of lawful presence before the state will issue a drivers license or ID card. Governor Gray Davis signed into law a measure that allowed drivers licenses for illegal immigrants. This, along with several other controversial measures, led to a recall election. Arnold Schwarzenegger campaigned during that recall election on a promise to repeal that measure, and did so shortly after he took office. In spite of the fact that the measure was wildly popular with illegal immigrants in the state, it was equally unpopular with citizens whose opinions trumped those of the illegal immigrants because illegal immigrants can't vote.

I expect the RealID act to eventually be repealed, primarily because it's unconstitutional. The federal government doesn't issue drivers licenses, and the 10th amendment should prevent them from dictating how states should issue them. I also expect that many states will continue to require proof of lawful presence before issuing a drivers license, and I expect in the future that CBP won't accept a license from a state that doesn't have this requirement as proof of lawful presence.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
