Which I-864 please?Does it also have to be notarized?

Hi there,....

In regards to an AOS from a student visa...here is the scenario....

Im a student so I dont work, so I am filling out an I-864...my dad is sponsoring my wife who is on an F-1 student visa. So WHICH I-864 does he fill out? I dont live with him anymore. There are a few I-864's to choose from, like the I-864A, and the EZfile one and the others on there...which one does MY DAD have to fill out??

...does the I-864's have to be notarized?? every page? or just the last one? even if she is here inside the U.S. the affadavits still have to be notarized or just signed by the sponsor and the co-sponsor??...

And does my dad have to get a letter from his employment stating he is employed?? we have his last 3 years of tax returns, he makes well over the limit almost into 6 digits so thats not the problem...

Second of all...when filing for an AOS from a student visa...do we have to include the almost $400 for the EAD application?? or is that free with the AOS application? I've heard its free...please correct me on it. She applied for an EAD before, and got rejected, but we have the letter for that previous one. She filed too early thats why while on her F-1 visa.

Can someone please help?? I want to send it off by thursday, its just this 1 hang up that im not sure of....If someone can PLEASE clarify this accurately a.s.a.p. I would great appreciate it a lot!

1. none of that needs to be notarized. At least that's what I've seen in this website and also from the instructions for the form.

2. you (usc) are the principal sponsor even if you don't have a job. Your dad is the co-sponsor or joint sponsor. That means you have to file one I-864 and your dad needs to do another I-864. He doesn't need a letter of employment, I was told that the most important thing are the tax statements. If he makes enough money and matches the poverty guidelines for the size of your household then it's fine. The I-864a is the contract between the co-sponsor/sponsor and the household member. In other words, between your wife and you and another between your wife and your dad.

3.the ead is free when you send it along with your AoS packet.

We're on the same boat. I'm trying to send this as fast as possible but we're missing a couple of things. Good luck.

The bolded portion is wrong.

A letter of employment is required to prove that you are currently employed. It is listed on the I-864 link page on USCIS.

The I-864A is not required because the OP and his wife do not live with his father. The I-864A IS a contract for a joint sponsor but it would be used if a household members income is being used. For instance. If the OP was living with his father the OP would complete the I-864 and include his fathers income on it, and the father would complete an i-864A allowing his income to be used on is sons I-864. The wife would complete one ONLY if her income is being used on her husbands I-864 and they live together.

Also. The father doesn't need to have the income of the OP's household size, he needs to have the income for HIS household size plus the immigrant.

No. The fees for the EAD and AP are waived when filed with AOS, or while AOS is pending.
