Hey all

Well my 2 yr green card expired on Dec 2nd. I sent my paperwork on in the 23rd Nov and tracked it via the USPS website to Vermont where it said it was ready for pickup from the PO Box.

Having not heard back since then, I went back to the USPS site today to make sure I hadn't missed anything and saw that the package had bounced back on the 25th (no notices received that I had a package waiting). Apparently this was because of lack of postage, though how that is possible I'm not sure (I used one of their self-service machines + express envelope), but regardless, I'm now in the situation where I'm filing late.

I need to go pick up the returned package tomorrow morning, and will immediately send it back, but do I need to include extra items now? Presumably a letter explaining the late filing would be a good idea, as well as a copy of the original tracking receipt, is there a late filing fee?

Any info would be much appreciated while I try to not panic!

Removal of Conditions (I-751) Timeline:

  • Nov 20th, 2011: Initial Submission Sent
  • Dec 3rd, 2011: Conditional Green Card expires
  • Dec 12th, 2011: Panic! USPS returned package to local Post Office on Nov 25th and didn't tell us!
  • Dec 13th, 2011: Re-sent Package (now late)
  • Dec 19th, 2011: NOA1 received
  • Jan 06th, 2012: Date of Bio Appointment
  • Aug 24th, 2012: Removal of Conditions Approved (letter received 8/29)

The story so far:

  • Aug 2003: Met future wife on her year abroad at university
  • 2005: After a year of long distance, enter USA on F1 visa (we knew we liked each other, weren't sure enough to get married)
  • May 2008: Finish courses, begin 1 year OPT
  • May 2009: Get Married, begin adjustment of status process
  • Dec 3rd 2009: Receive conditional green card

Did you include a letter explaining any reason why you were late? If you did I don't think you need to panic too much, I filed mine about 2 weeks late and the CSC accepted it.

Just wait for the AOS letter which acts as a receipt to arrive in the mail and wait for your Biometrics appointment.

I'm sending the late one tomorrow morning (will be at post office first thing to pick up the returned package, so that I can resend it), and it will include the letter explaining lateness, as well as copies of the USPS receipts etc.

Hopefully things will work out!
