I am posting today

As after a very smooth k-1 visa process ead in hand fiance working low and behold after not a single issue on the final run of this AOS ( EAD received) I get the dreaded RFE for the los medical that my fiancé clearly handed over when she entered Dullis airport

Given the cost of this process and the fact you can’t open the brown folder to make copies this is in no way shape or form our fault or any visa holders fault that it’s lost

Has anyone successfully gotten this corrected without having to do another medical and pay for something twice that you already paid for ?. if so please let me know how and what you did to go about this . I know you can get a senator to try and bark for you and I know the 200-300 dollar new medical can fix this but this is absurd and not right.

Any emails or numbers you have called will help I know not everyone goes this route and some just pay for the new medical but remember closed mouths don’t get fed and ill scream till I get heard

They certainly don’t lose your checks when you send them so they should not lose the most important and expensive part of the immigration process

You should start by chasing after your medical. Call the port of entry or go in to where the port of entry was and find out what happened to the file and go from there.

Most people just pay for the new medical because they don't want to deal with the issue of trying to run down the previous file and the rudeness people give them when they try to do it.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Timeline

You can:

1. Pay for a full medical

2. Get your congressman/senator involved

3. Make an INFOPASS and tell them to check your "A" file

4. Contact your home country panel physical (where you did the K1 medical) and see if they will forward you a copy (if they kept one).

The only one that's guaranteed is #1. I would try #4 first, then #2 & #3 and #1 as a last resort. You have to ask yourself whether standing up for what you think is "right" is worth having AOS denied.

If you would read our thread at http://www.visajourney.com/forums/topic/321561-lost-medical-records-scam/ you would know what happened to us.

We "chased" what happened to my packet, and spent some money calling the hospital and the embassy, back and forth. The congressman's office even tried to help us. We also sent a petition to the FOIA (Freedom of Information Act) office of the USCIS, but that also required a lot of documentation including notarized affidavits. The bottomline though is even though the clinic/hospital where I did my medical was very much willing to send another copy of the records, they needed an official request from the US Embassy, and the US Embassy needs the official request from the USCIS, so it's complicated pass-the-message game and it was the embassy and the USCIS that was the toughest offices to reach and to push to act on our requests. I preferred doing that over getting another Infopass, because these were things that I could do from home, especially because my husband was always busy with his work, and can't take me to the USCIS on the very few open days for Infopass.

As we reached closer and closer to the deadlines, I just ran out of patience with all the red tape, and got another Infopass and made my husband take me to the local office. He had to rush home from work, without sleep and without breakfast, to pick me up and go with me to the USCIS and wait there for 2 hours until they could see us. Fortunately for us, we were able to talk with different people, and basically, they found the whole thing fishy too (as we can see from their gestures and some words that they used, although they tried their best to not make it appear like there was someone who did something wrong). They talked among themselves (both the officer we talked to, and what must be the receptionist), and "found" my papers, even though they weren't supposed to even see them until the next week because they were in a lockdown then due to a quarterly audit.

In summary, I advice for you to just wait another week or two and schedule another Infopass, and ask for another officer or their supervisor. Make sure that you complain and escalate the problem to them, and don't just let them talk you into doing another medical when it was obviously their fault. A lot of people are just too scared to complain because of the USCIS officers' discretionary power to judge you and say that you didn't pass, so they just did what they were told even if it was very very inconvenient for them. We did not, and we dared complain and ask questions, although we were still too dazed (and hungry and sleepy) during the actual interview that we failed to do that then and there, and did not fully realize what happened until we were out in the car. They may have the power to make your life difficult, but they can still be investigated and found faulty by their supervisors.

If all else fails, my CS in PA only charged me less than $150 for a full medical. I was pressed for time to get my GC because I was starting school and they needed my GC for me to begin, so the day I got my RFE I scheduled a CS appointment, had the paperwork two days later, mailed it in and got approval 1-2 weeks after that. I did however, call around until I found a CS who did a full medical for a cheap price. I was lucky that she was only 20 minutes away! I still got my GC in less than 3 months total. In my opinion, the extra $150 was worth it. I needed to show my school that I had no TB and other communicable diseases anyway since I was working with kids, so I was able to use it again. And the same CS did my medical for the driver's license for free together with the I-693. She's awesome and legit!
