We have been planning on submitting the Fiancee Visa petition for a long time.

Our g-325a's and Letter of Intent were prepared and signed one year ago.

Can we still use these? Or must we provide new signatures and dates?

What is the maximum time difference allowed between the dates the g-325a and Letters of Intent

were signed, and the I-129f can be submitted?

were signed, and the I-129f can be submitted?

There is no stated time limit for the dates on the above listed items and when the I-129F can be submitted. The information just needs to be the same.

Our journey:

Spoiler

September 2007: Met online via social networking site (MySpace); began exchanging messages.
March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

there is no particular limit but I would think one year is too much. There may be a concern that the G-325a info is no longer accurate. If you insist on using it as is and not update it (why would you not update it?) then attach a letter explaining why and that all information is still correct.

Understand that doing so you are still risking an RFE which will add weeks to the process.

You need to be certain the G-325A edition is current! You could just complete and e-mail a new G-325A and EOR to her, she can print out and sign, Then she can mail or fedex back to you, so you have fresh and current forms!

Education is what you get from reading the small print. Experience is what you get from not reading it.

You need to be certain the G-325A edition is current! You could just complete and e-mail a new G-325A and EOR to her, she can print out and sign, Then she can mail or fedex back to you, so you have fresh and current forms!

I would highly reccomend Not to send a 325-A or Letter of Intent that is a year Old. This would mean the Currant Information is Outdated. Also, Pictures, letters would be a year old as well. Wanna Spell "Red Flag from the Start"..

The I-129-F has just a few requirements to get a NOA1.

Guess the point is: Sending information from a year ago.

Many people have received RFEs for updated G-325as and also for updated affidavits of support at the visa interview. Personally I have not because I would never send an old G-325a. In fact, I have never received an RFE of any kind so maybe I am not experienced enough.

There IS NO guideline as you have been told. This is not wrong. There IS NONE.

Good news? There is NONE

Bad news? There is NONE.

It is up to the individual judgement of the adjudicator and if the adjudicator decides they want something more up to date, then you get an RFE. An RFE will typically add 4-6 weeks to the process, possibly more PLUS whatever time it takes you to get the documents you need after they send the RFE.

So do the "risk/reward" calculation and pay your fee and take your chances.

Having been through the entire process with a finacee and two children I can tell you that there is NO WAY I would consider sending a 1 year old G-325a for even 1 second. This is what we call a "no brainer". You nay as weel get a new letter of intent while you are at it. It would be kind of silly to update one and not the other.

There are NO Legal Requirements to this. Meeting in 2 Years. But use your Common Sense. You as the Petioner sending Information a year Old and Outdated. Well, you aint going to save ony Money IF you get a RFE

I would play it safe and just get new documents, it only takes 10-12 days for snail mail to arrive from China costs about $ 3.00 USD. Even faster with UPS but more expensive. I think you will avoid a possible RFE which will cost you about 2-3 weeks delay in your case processing since RFE's have to be snail mailed back to USCIS. I also think the person processing your case would also wonder why the info is old ( were they having problems and ever thing went on hold? What kinda of problems were they having?) I was playing processor there for a moment for you to see how or why the old form and EOR may cause you problems! Anyway, Good Luck!:thumbs:

Put yourself in the Consulate Officers position for a minute. Wouldn't you think it would look like to him there is a problem with your relationship, maybe

you are not so committed if you waited a year to submit it ? It MIGHT raise an unnecessary flag even if the paper work is in order.. don't risk it.

If you are serious about filing, get a recently signed one oppossed to one that is a year old.

(I posted this and then saw that the previous poster has the same opinion as I.)
