how do I know that my co sponsor qualifies?

Hi everyone,

since ive been residing with my spouse for the past 7 months in Argentina, I need a co sponsor for my petition. I want to use my brother in law. He isnt actually married to my sister but he has two kids with her. the thing is that my sister lives in my parents home and he lives with hs family. He makes more than 40k a year but my sister receives foodstamps and medicaid for her two kids since she resides with my mom and dad and they both receive it too. My dad had a kidney transplant two years ago but works in a hospital but only makes 23k a year and I have 4 siblings along with my two nieces. So I have no idea how to know if he qualifies and that he also did his taxes with her. So what do I do to make sure he qualifies? He has a vehicle under his name and cell phone but thats it. I dont want to send my petition and then not get the visa for my spouse if I don't qualify. Help please.

These are the current poverty guidelines that the sponsor/joint sponsor needs to meet:

You need to take in consideration the household size (are all your siblings living at home along with your nieces?). You can also use those other members of the household's income in addition to your father's income to meet those requirements.

Basically you can use anyone as a co-sponsor. You yourself still need to fill up a I-864, you know that right? and then your co-sponsor fills one up too. If he is making 40K it should be ok. They will go by his dependants. Look at his tax return and see how many dependants he claims, thats what the embassy goes by. Then look at the poverty guidlines to make sure he qulifies

but no one else in my household works..n dey receive gov. benefits. my brother in law doesn't though but he lives with his grandparents whom both work and has 2 sisters who dont work. so How do i know

Basically you can use anyone as a co-sponsor. You yourself still need to fill up a I-864, you know that right? and then your co-sponsor fills one up too. If he is making 40K it should be ok. They will go by his dependants. Look at his tax return and see how many dependants he claims, thats what the embassy goes by. Then look at the poverty guidlines to make sure he qulifies

he has his two daughters as dependants but they receive gov. assistance though so how do i go about that.

You're being a little vague on how many household members there are and whether they're dependents or not. Start by re-reading the I-864 instructions and filling it out. For example, here's a useful tidbit for determining where you're at:

Your household size includes yourself and the followingindividuals, no matter where they live: any spouse, anydependent children under the age of 21, any other dependentslisted on your most recent Federal income tax return, allpersons being sponsored in this affidavit of support, and anyimmigrants previously sponsored with a Form I-864 or FormI-864 EZ affidavit of support whom you are still obligated tosupport. If necessary to meet the income requirements to be asponsor, you may include additional relatives (adult children,parents, or siblings) as part of your household size as long asthey have the same principle residence as you and promise touse their income and resources in support of the intendingimmigrant(s).

Does your brother-in-law live alone? So it's just him and his two daughters that make up his household size?

no he lives in his grandparents home but they both work.and he has two sisters

I'm not knowledgeable about the information to which the consulate will have access in relation to your co-sponsor but I would say that you should be prepared to answer questions about the co-sponsor's situation. I was asked for more specifics on my co-sponsor. I hope someone will chime in, but it may be possible they know he lives with others (the siblings and parents) and will want to be assured that they are not his dependents in any way. Just come armed with information should you need it.
