We didn't submitt all necessary documents for I-130

Thaaankkk you..So there is nothing that we can do now while waiting their response?

Actually you can figure out what you were suppose to send and send it now. Make sure you attach a cover letter to everything and explain you forgot to send in all this stuff with your I-130. You dont need to wait for an RFE. I know people who have done this before and had no problem.

Yeah but they didn't send in all the forms like the instruction say to do, thats why I dont think they will get denied. It is grounds to get rejected though. Rejected is not the same as denied. I put my money on they will get an RFE, thats all i'm saying. And I did read your post, you said after 5.5 months you didn't get an RFE just a denial. Well did they say they sent an RFE and you never responded? Did they tell you why the case was being denied?

Most denials happen not for lack of papers or evidence, other things come into play like was the petitioner or beneficiary arrested or have a criminal record? Is the marriage certificate sent in check out with vital stats, is the petitioners divorce decrees recorded in their state's vital stats office, etc etc etc .

I'm not saying you didn't get screwed, believe me I am on your side and i'm really sorry you guys got denied for probably some silly reason. Im just saying it shouldn't happen and they should give them a chance to fix it.

Thank you for giving us a little hope..In January will be 5 months..I hope we'll get some info soon?!:(

The people you know who have done that before must have gotten lucky. I say that because anything sent to USCIS unsolicited is usually an exercise in futility because such items usually do not get matched with the file.

September 2007: Met online via social networking site (MySpace); began exchanging messages.
March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

you could try sending in the missing documents (include your receipt# and everything that yould help them link it to your I-130) maybe you´ll get lucky and they add it to your original petition... but i really don´t know if that could work... otherwise if you move make sure to get you mail fowarded to your new address just in case you really get a RFE.

i don´t know if calling them helps. but i guess it´s wort a shot...

Actually, it is absolutely proper to deny instead of RFE when required "forms" are not submitted.

i can assure you that we didn´t get a RFE. and yes, they told us why we got denied. because we didn´t send in all the evidence they wanted to see. if we would have gotten a RF it would have been an easy fix coz we had everything ready waiting for a RFE. criminal records!? i wouldn´t be married to my husband if he had criminal records! we both have never been married, have no kids, are the same age, our families know and like each other,... believe me, there was no reason to deny us except for the fact that we didn´t send in everything. just because we thing everybody should get a RFE if the file is missing something and everybody should get a chance to fix what´s missing doesn´t mean that uscis agrees with us.

There are not guarantees, but you can submit the missing documentation now with a cover letter indicating the WAC or EAC case number. They MIGHT accept it and get it put together in your file. It only costs the postage.

The people you know who have done that before must have gotten lucky. I say that because anything sent to USCIS unsolicited is usually an exercise in futility because such items usually do not get matched with the file.

i didnt send any evidence that support the bonafides of our relationship at all...and i never got an RFE for not submitting any evidence to prove our relationship except for the marriage cert....when i filed for I-130 I included our marriage/birth certs..copy of my passport, my citizenship, g325, our pics (passport size) and check...

The real role of the USCIS is to make sure everything is good and in order, and everyone qualifies as a relative. Its the NVC and then the Embassy who will investigate the bona fides of your relationship. I think most of the people here reading haven't been in the NVC phase yet. Wait and see.

You should send in pictures, you should send in atleast 3 affidavits from people who know you and can atest that your marriage is real, some emails between you, txts between you.

you dont have to send it..its your choice to send any evidence for my understanding..but when you go for visa interview you gotta bring it with you coz for sure they will ask..we have lots of pictures together, remittances from 2009-present, i printed my detailed phone bills, also, copied of my stamped passport..and my roaming sim card packaged..that should be enuff

YES U ARE RIGHT USCIS ROLE IS TO MAKE SURE EVERYONE IS QUALIFIES AS A RELATIVE. THEN GOES TO NVC...CHECK THAT ALL DOCUMENTS ARE IN YOUR FILE, COLLECT FEES...THEN GOES TO EMBASSY WHO MAKE THE DECISION BASED ON THE DOCUMENTS YOU HAVE SUBMITTED AND THE EVIDENCES YOU BRING TO THEM...
