My husband and I are filling the form I-864 (Affidavit of support) and we are confused about Part 5. (Sponsor's household size)

This part counts the number of people my husband is financially responsible for. Which is me (his wife) and him.

They ask to put numbers next to the different categories and add them at the end. But they ask for "persons you are sponsoring in this affidavit" (1 = me) And then "persons not sponsored in this affidavit" (1 = him) but there is a section under this same part that says "if you are currently married, enter 1 for your spouse" (1 = me) But that will give as 3 people at the end because we are counting me twice!

What is the correct way of filling this part of the form.

First does your husband qualify to use the I-864EZ ( a shorter version of the I-864). it was created for certain indiiduals who meet the eligibility to use and these requiremensts are:

You may use Form I-864EZ IF ALL the following conditions

apply:

1. You are the person who filed or is filing the Form I-130,

Petition for Alien Relative, for a relative being sponsored;

2. The relative you are sponsoring is the only person listed on

the Form I-130 petition;

3. The income you are using to qualify is based entirely on

your salary or pension and is shown on one or more Forms

W-2 provided by your employer(s) or former employer(s).

so if your husband is the one who filed for you, you are the only one on the peition and he is a salaried worker then he should use this shorter and simpler version.

forthe I-864 even though you will appear under part 5 21-C, you should put the total as 2..cos you shd not count yourself twice you the principal applicant and sponsor' spouse are ONE AND THE SAME PERSON...( thats what I think though, pls someone correct me if I am wrong)

09/26/2012: Mailed I-130 from Nigeria( delayed by customs)
USCIS stage ( 66 days)
10/12/2012: NOA 1
12/17/2012: NOA 2 (case was transferred to NYC office 11/27/12)
NVC stage ( 20 days)
01/08/2013: Case # and IIN assigned ( file arrived NVC mail room 12/20/12)
01/09/2013: AOS invoiced and paid, DS-3032 emailed and mailed.
01/16/2013: IV invoiced &paid. AOS & IV mailed in one package(arrived 01/18).

01/28/2013: Case complete!!!
04/19/2013: Interview; APPROVED!!!!!
05/13/2013: POE; JFK


N-400: (3 months and 12 days)
Filed N-400 : 2011-06-17
Interview: 2011-09-27
Oath Ceremony: 2011-09-30

IR-5 for Mom Entire process took 5 months exactly
USCIS (22days)

mailed I-130 : 2011-09-30
NOA 1: 2011-10-03 (text & email)
NOA 2: 2011-10-25 (text and email)
NVC: (19 days)
Case entered and # assigned: 2011-11-18
NVC Case COMPLETED: 2011-12-07 ( 43 days from NOA 2 and 65 days from NOA 1)
Interview Date(Lagos): 2012-01- 23
Mom was late for interview
New Interview date: 2012-02-29 : VISA APPROVED
